QUESTIONER: "Senator McCain, when you're elected president what sort of judges will you appoint? Will they be of the living constitution sort or of the strict constitutionalist?"
MCCAIN: "Thank you for the question. My friends, one of the things we have a tendency not to think as much as we should about is the appointment of judges; especially those to the United States Supreme Court. I don't know but some people—a lot of people say there could be as many as two or maybe even three retirements from the United States Supreme Court within a certain number of years.
"I don't know if it's true or not but always there is and so it's very important. And by the way, this is one of the big differences between me and Senator Obama. I happen to think that Justice Roberts and Justice Alito are two of the finest appointments to the United States Supreme Court because they had a record and now have a record of strictly interpreting the Constitution of the United States of America and not legislating from the bench and Senator Obama [...] voted against Justice Roberts and he wanted to filibuster against Justice Alito. So that's a very clear difference between myself and Senator Obama, my friends. Obviously he's for these activist judges and why anybody would vote against Justice Roberts—that's just not within my imagination."
