Read Froomkin...read it all. Here's a significant sample:

Buried in the files of former White House counterterrorism czar Richard Clarke, the documents seemed to confirm charges that the Bush White House had ignored repeated warnings about the threat posed by Osama bin Laden. Clarke, it turned out, had bombarded national-security adviser Condoleezza Rice in the summer of 2001 with impassioned e-mails and memos warning of an Al Qaeda attack--and urging a more forceful U.S. government response. One e-mail jumped out: it pleaded with officials to imagine how they would feel after a tragedy where 'hundreds of Americans lay dead in several countries, including the U.S.,' adding that 'that future day could happen at any time.' The memo was written on Tuesday, Sept. 4, 2001 -- just one week before the attacks on New York's World Trade Center and the Pentagon.
"But when Bass tried to impress the significance of what he had discovered upon the panel, he ran into what he thought was a roadblock -- his boss. Philip Zelikow, a respected University of Virginia historian hired to be the 9/11 Commission's executive director, had long been friendly with Rice. The two had coauthored a book. Rice had later placed him on a Bush transition team that reorganized the NSC (and ended up diminishing Clarke's role). At Rice's request, Zelikow had also anonymously drafted a new Bush national-security paper in September 2002 that laid out the case for preventive war.
"In commission staff meetings, Zelikow disparaged Clarke as an egomaniac and braggart who was unjustly slandering his friend Rice, according to [Shenon's] new book. . . .
"Rove himself, according to Shenon, always feared that a report which laid the blame for 9/11 at the president's doorstep was the one development that could most jeopardize Bush's 2004 re-election. That's one reason why White House lawyers tried to stonewall the commission from the outset. When Clarke finally did testify about his warnings to Rice, Shenon reports, White House counsel Alberto Gonzales and his aides feverishly drafted tough questions and phoned them in to GOP commissioners to undermine Clarke's credibility. Later, when Attorney General John Ashcroft unveiled a memo that seemed to cast the antiterror record of the Clinton Justice Department in an unflattering light, Gonzales and his aides high-fived each other."

How about Unethical Embarrassment of the Year?

On Friday, Editor and Publisher of the American Bar Association Journal Edward Adams released a statement saying that fallen Bush Attorney General Alberto Gonzales, previously named "Lawyer of the Year," will now be known as "Newsmaker of the Year."
"The Journal regrets that we did not make this theme clear," clarifying that the Journal article in question meant to highlight Gonzales' status as a "newsmaker," and their story on him will remain unchanged otherwise.
"We appreciate the feedback we've received," says Adams, "and we're acting on it."

That's more than our own government is doing.

Gonzo: Lawyer of the Year. What next, Bush gets Nobel Peace Prize?

Yes, yes, I understand the concept here. But still, putting the words "Gonzales" and "Lawyer of the Year" together makes me throw up a little in my mouth:

Negative news coverage may have cost former Attorney General Alberto Gonzales his job, but it won him a dubious honor Wednesday from a magazine published by the American Bar Association: Lawyer of the Year.

I wonder if he'll recall getting it.

The monthly magazine gave the awards to lawyers who made the most news, said editor and publisher Edward A. Adams.
"Think about Time magazine's Person of the Year," Adams said in an interview. "In years past they've named people like Adolf Hitler, Joseph Stalin. So we're not suggesting by these awards that these are the best lawyers in any sense of the word. We are saying they are the most newsworthy -- and perhaps also the best."

Comparing our former Attorney General to Hitler and Stalin is so reassuring. How proud we should be! On the upside, Gonzo probably won't recognize those names and will continue his restful stay in Hotel Oblivion.

Other high-profile lawyers that were nominated for the distinction included Goodling, the Justice Department's liaison to the White House who quit in April amid the political firestorm; I. Lewis "Scooter" Libby, Vice President Dick Cheney's former chief of staff who was convicted of perjury and obstruction of justice in the investigation into the leaked identity of former CIA operative Valerie Plame Wilson; and U.S. Attorney Patrick Fitzgerald, the top prosecutor in Chicago who won the case against Libby.

It's not whether you win or lose, it's how you play the game. Or is it, how you game the system?

I wonder who Time's Person of the Year will be, Michael Vick?

Poor Alberto Gonzales. He's gotten himself into so much hot water that he's felt it necessary to create a trust fund to help pay for his legal expenses. That scamp. Always into mischief.

If he did commit perjury, if he did he improperly tamper with a congressional witness, then he's a gen-u-ine stand out!

The establishment of a legal-defense fund for the nation's former chief law-enforcement officer illustrates the potential peril confronting Gonzales, one of a handful of attorneys general to face potential criminal charges for actions taken in office.

Forget about Paddy's frozen toes and my out-of-work, picketing writer. Gonzo needs your money NOW!

David Leitch, a Gonzales friend and general counsel at Ford Motor, wrote in an e-mail solicitation to potential contributors last month that Gonzales is "innocent of any wrongdoing" but does not have the means to pay for his legal defense after a career spent mostly in public service.

Tsk, tsk! Do you feel his pain? Then GIVE! Show your compassion!

"In the hyperpoliticized atmosphere that has descended on Washington, an innocent man cannot simply trust that the truth will out," Leitch wrote.

Just as Scooter Libby was innocent, so is Gonzo! Let him know you care! Donate!

A contribution form asking for donations to the Alberto R. Gonzales Legal Expense Trust suggests amounts from $500 to $5,000.

Who can resist an appeal like that?

Mukasey worse than Gonzo. And yes, that's possible

Via The Nation, John Nichols explains why Michael Mukasey is much worse than Alberto Gonzales ever was:

For instance, he has defended the administration's attempts to dramatically expand the definition of executive privilege, telling the Judiciary Committee that it would be inappropriate for a U.S. attorney to press for contempt charges against a White House official who claimed to be protected by a grant of executive privilege. Under this reading of the law, U.S. attorneys would cease to be independent defenders of the rule of law and become mere extensions of the White House.

Guess he's not as "independent" as he says he is. I'm getting angrier by the second with Dianne Lieberman.

As such, Mukasey accepts a politicization of U.S. Attorneys far more extreme than that attempted by Gonzales and former White House political czar Karl Rove when they sought to remove U.S. Attorneys who failed to fully embrace the administration's electoral and ideological goals.

On to unwarranted wiretaps:

But Mukasey does not stop there.
Under questioning from Feingold, Mukasey endorsed the administration's argument that congressional attempts to define appropriate surveillance strategies and techniques could infringe inappropriately on presidential authority.
When pressed by Feingold, Mukasey refused to say whether he thought the president could order a violation of federal wiretapping rules. Feingold's response was measured. "I find your equivocation here somewhat troubling," said the senator.

And because he's smarter, more articulate, and more adept at answering, he's that much more dangerous:

In fact, everything about Mukasey's testimony suggested that he would as Attorney General be more of a threat to Constitutional governance than the inept and frequently inarticulate Gonzales. Mukasey gives every indication that he is as enthusiastic as was Gonzales about helping the president to bend and break they law. The scary thing is that Mukasey appears to be a good deal abler when it comes to cloaking lawlessness in a veneer of legal uncertainty.

Read: Better at legal doubletalk, better at fooling a willingly-fooled Congress, better at getting what Bush wants.

Consider the nominee's suggestion that the president can ignore any law, including the Foreign Intelligence Surveillance Act, if he and his lawyers determine that the law impinges on his authority as commander in chief during wartime.
"The president is not putting somebody above the law; the president is putting somebody within the law," Mukasey explained, with a response that employed legalese at levels not heard in Washington since Richard Nixon boarded that last plane for San Clemente. "The president doesn't stand above the law. But the law emphatically includes the Constitution."

And we're watching this happen. We're sitting in front of our CSPAN3s and witnessing this horrific train wreck as it occurs. That explains the sick feeling in our stomachs right now.

Leahy said after that "troubling" statement by the man who would be the nation's chief law enforcement officer: "I see a loophole big enough to drive a truck through."
The Judiciary Committee chair is right. It's the truck carrying the trappings of an imperial presidency. And Mukasey should not be handed the keys.

We need a designated driver. Now.
