The American University School of Communication Center For Social Media has published a Code of Best Practices in Fair Use for Online Video:

Without the second half of the bargain, we could all lose important new cultural work just because one person is arbitrary or greedy.
Copyright law has several features that permit quotations from copyrighted works without permission or payment, under certain conditions. Fair use is the most important of these features. It has been an important part of copyright law for more than 150 years. Where it applies, fair use is a right, not a mere privilege. In fact, as the Supreme Court has pointed out, fair use keeps copyright from violating the First Amendment. As copyright protects more works for longer periods than ever before, it makes new creation harder. As a result, fair use is more important today than ever before."

"The Yiddish/Aramaic word "chutzpah" is well known, and has been defined variously as gall, audacity, insolence, and impertinence. Patrick Ross, head of the cartoonish Copyright Alliance, seems to have chutzpah in abundance, as seen on a blog post yesterday criticizing The Center for Social Media at American University, for its release of a "Code of Best Practices in Fair Use for Online Video." The best practices are a "Future of Public Media Project," funded by the Ford Foundation, a fact Mr. Ross omits.

Mr. Ross is not a lawyer, but formerly was with the right wing Progress and Freedom Foundation, which usually acts as a mouthpiece for corporate copyright owners. I have no idea whether or where Mr. Ross attempts to learn about copyright law, much less fair use. For my part, I have been a practicing copyright lawyer for 25 years, and have been studying fair use even longer, beginning in law school. In 1985, I wrote my first book on copyright, which was also the first book devoted just to fair use. The treatise's first citation was by the Supreme Court in the Harper & Row case, issued shortly after the treatise came out. Subsequently, that treatise has been cited many more times by other courts. I have testified before a joint session of the IP subcommittees of Congress on fair use, worked on amendments to Section 107 as a Congressional staffer, argued fair use cases in the courts of appeals and district courts, written an article about fair use with Judge Posner, advised many clients about it, and discussed the issue with the European Commission, and many representatives of foreign governments. I am unaware of any qualifications Mr. Ross has to talk about fair use.

Nor is Mr. Ross an educator. Yet, regarding both fair use and education, in his criticism of the Center's Best Practices, he speaks as if he knows more than those who are copyright lawyers and educators (and some who are both), beginning with a pompous, purported correction about the nature of fair use, scolding the Center for daring to utter the term "right" in the same sentence as fair use. . . ."

SARAH PALIN: If you're thinking, though, that the Democrat majority in Congress will at least then be able to shore up the leadership gap for an untested Commander-in-Chief, think again. Because the other day, House Finance Committee Chairman, Barney Frank [crowd boos] said [...] that the Democrats intend to cut defense spending by 25 per cent [crowd boos] -- to gut the defense budget.

We're fighting two wars. We need a force strength in need of rebuilding, not in being gutted. And they think it's the perfect time to radically reduce defense spending. What are they thinking?

They even tie these cuts to projected savings from the forced withdrawal, that early surrender in Iraq that Barack Obama has talked about [crowd boos] -- I guess what we might call a retreat dividend is what they're talking about. It's the far left wing of the Democratic party, not mainstream thinking. [...] They're preparing to take over the entire federal government. And according to their own stated plans, the first thing to go will be one quarter of the United States defense budget. [crowd boos]

Now I don't know how many of you have a loved one [...] serving over there in Iraq or Afghanistan right now. Surely you know people who have served over there. Now I'm a Blue Star mom, which means I have a teenage son over in Iraq fighting right now [crowd cheers] and I met with a group of other Blue Star moms fairly recently. And we got to thinking about this. One of them suggested, after Barack Obama had supported cutting off funding for our young men and women -- America's finest, over there protecting our freedom, fighting the terrorists -- wanted to cut off funding for their rations and ammunitions and their equipment. And one of the Blue Star moms says, What are we supposed to do? Throw a bake sale? [crowd grumbles] What are they thinking?

John McCain and I, we have a better idea. Let's not retreat from wars that are almost won. And let's not gut the defense budget! [crowd cheers] Let's not gut the defense budget in a time of multiple conflicts and obvious dangers. This is a time when we need to grow our military. And let's not entrust all the powers of the federal government to a one-party rule of Obama, Pelosi and Reid! [crowd boos]

In 5 days, it's all gonna come down to a choice between 2 men [...] And you know, a man can be admirable in many ways and quite promising, and yet still not be quite ready for the most important and demanding job in the world. Rousing speeches can fill a stadium, but they cannot keep our country safe!

The Iraqi government has criticised US military chief Mike Mullen for warning of "major security losses" if Iraq does not pass a key security deal.

Previously, US Defense Secretary Robert Gates has warned of "dramatic consequences" if Washington and Baghdad do not agree a security deal on US forces in Iraq.

In an unexpected move, Iraq's cabinet is demanding changes to a draft deal already agreed with Washington, which would allow US forces to stay in Iraq until 2011.

The draft has also been strongly opposed by the faction led by radical Shia cleric Moqtada Sadr, who brought thousands of supporters on to the streets of Baghdad on Saturday in protest. It has also been opposed by Sunni Muslim clerics and other opposition parties in Iraq.

Michael Chertoff is the second US secretary of Homeland Security for the US Department of Homeland Security. He was sworn into this position in 2005. Formerly, Chertoff served as United States circuit judge for the Third Circuit Court of Appeals. He was previously confirmed by the Senate to serve in the Bush Administration as assistant attorney general for the Criminal Division at the Department of Justice. As assistant attorney general, he helped trace the 9/11 terrorist attacks to the al-Qaida network, and worked to increase information sharing within the FBI and with state and local officials.

Jeffrey Goldberg is the staff writer and Middle East correspondent for the New Yorker Goldberg, based in Washington, D.C.. He joined the staff of the New Yorker in 2000.Previously, he was a writer for the New York Times Magazine, covering the Middle East and Africa. He has also covered the mafia for New York Magazine, served as the New York bureau chief of the Forward, and been a columnist for the Jerusalem Post. Andrew Krepinevich is a defense policy analyst, president of the Center for Strategic and Budgetary Assessments, and Distinguished Visiting Professor at George Mason University's School of Public Policy.

Scott Kleeb is an American rancher, professor, and political candidate in Nebraska. Kleeb is the Democratic candidate in the election for the open US Senate seat being vacated by Republican Chuck Hagel.

John P. Holdren is Teresa and John Heinz Professor of Environmental Policy and Director of the Program on Science, Technology, and Public Policy at the Kennedy School, as well as Professor of Environmental Science and Public Policy in the Department of Earth and Planetary Sciences at Harvard University. His work focuses on causes and consequences of global environmental change, analysis of energy technologies and policies, ways to reduce the dangers from nuclear weapons and materials, and the interaction of content and process in science and technology policy.

Bruce Blair is president of the World Security Institute, a nonprofit organization that he founded in 2000 to promote independent research and journalism on global affairs. Blair is an expert on US and Russian security policies, specializing in nuclear forces and command-control systems. Blair, a MacArthur Prize awardee, has taught security studies at both Harvard and Yale universities.

Jeffrey Goldberg is the staff writer and Middle East correspondent for the New Yorker. He joined the staff of the New Yorker in 2000.
