government</a>:</p><blockquote><strong>In a stinging ruling, a Los Angeles federal judge said immigration officials&#39; alleged decision to withhold a critical medical test and other treatment from a detainee who later died of cancer was &quot;beyond cruel and unusual&quot; punishment.</strong><br /></blockquote><p>I&#39;m sure the judge simply forgot that <a href="http://www.cnn.com/2008/POLITICS/03/08/bush.torture.ap/">the U.S. is proud</a> of our <a href="http://seattlepi.nwsource.com/opinion/335178_thomas12.html">&quot;cruel and unusual&quot; punishment</a>. An understandable lapse; we can let it pass just this once.</p><blockquote> The decision from U.S. District Judge Dean Pregerson allows the family of Francisco Castaneda to <strong>seek financial damages from the government</strong>.<br /><br /><strong> Castaneda, who suffered from penile cancer, died </strong>Feb. 16. Before his release from custody last year, <strong>the government had refused for 11 months to authorize a biopsy for a growing lesion, even though voluminous government records showed that several doctors said the test was urgently needed,</strong> given Castaneda&#39;s condition and a family history of cancer, Pregerson said.</blockquote><p>There&#39;s that compassion issue raising its ugly head again. What man really needs a penis anyway, right?</p><blockquote><p><strong>But rather than test and treat Castaneda, government officials told him to be patient and prescribed antihistamines, ibuprofen and extra boxer shorts,</strong> the judge wrote in a decision released late Tuesday. In summary, the judge wrote, <strong>the care provided to Castaneda &quot;can be characterized by one word: nothing.</strong>&quot;</p></blockquote><p>What, boxer shorts don&#39;t cure cancer? Since when?</p><blockquote><p> <strong>Pregerson blasted public health officials&#39; &quot;attempt to sidestep responsibility for what appears to be . . . one of the most, if not the most, egregious&quot; violations of the constitutional prohibition against cruel and unusual punishment that &quot;the court has ever encountered.&quot;</strong><br /> <br /> At this stage of the proceedings, &quot;the only question is whether&quot; the plaintiffs&#39; allegations, if true, show that <strong>government officials &quot;were deliberately indifferent to his condition. The court finds that they do,&quot;</strong> Pregerson said. </p></blockquote><p>Here&#39;s what the Bad Immigrant was accused of:</p><blockquote><p>[T]he Salvadoran immigrant spent eight months in custody on a charge of <strong>possession of methamphetamine with intent to sell, then was transferred to immigration custody because he did not have legal residency.</strong> </p></blockquote><p>Now he&#39;s dead.<br /> </p><blockquote><p>&quot;<strong>Mr. Castaneda&#39;s case was just outrageous,&quot; Rep. They&#39;ll have perfectly fair and just hearings, be released, and feel good as new!</p><p>And hell will freeze over.</p><p>According to Navy Captain Theodore Fessel, Jr., &quot;...<strong>authorities have begun seeking new or previously overlooked evidence</strong> that may warrant new hearings after the process came under fire.&quot; </p><p>Let&#39;s examine that last part: After 6 years of calling these guys terrorists, keeping them locked up indefinitely under horrid conditions, and destroying them physically and psychologically, they suddenly have &quot;new&quot; or &quot;overlooked&quot; evidence that just happen to materialize?&nbsp; Because <em>now</em> these guys are worth a second look?</p><blockquote><p>&quot;<strong>With all the outside eyes looking in at the process, it&#39;s forcing us to say, &#39;OK, did we take everything into consideration</strong> when we did the Combatant Status Review Tribunals?&#39;&quot; </p></blockquote><p>When nobody&#39;s looking, it&#39;s okay to mangle humanity, but now they&#39;re &quot;<em>being forced</em>&quot; to reconsider? Give me a minute. I&#39;m having an aneurysm.</p><p>Lt. Col. Stephen Abraham, an insider who has become one of the most prominent critics of the tribunal process: </p><blockquote><p>&quot;Ultimately, conducting new CSRTs &mdash; even discussing the possibility &mdash; <strong>repudiates every prior assertion that the original CSRTs were valid acts...</strong> <strong>They are, in essence, both a hypocritical act as well as an act of moral cowardice.&quot;</strong></p></blockquote><p>He knows what he&#39;s talking about:</p><blockquote><p><strong>Abraham,</strong> an Army reservist who was a liaison between Guantanamo tribunals and intelligence agencies and served on a combatant review panel, <strong>made headlines this summer when he told Congress and the Supreme Court that tribunal members felt pressured to find against detainees. </strong></p></blockquote><p>So this move is supposed to cover those who no longer pose a threat &quot;in the spirit of being an open and fair process&quot;. </p><p>1) It&#39;s never been an open and fair process.</p><p>2) Most of them most likely didn&#39;t post a threat in the first place.&nbsp;</p><p>3) I&#39;m pissed off.</p><p>Out of the original <a href="http://en.wikipedia.org/wiki/Guantanamo_Bay_detention_camp#Facilities_and_detainees">775 or so</a>, &quot;its population will likely continue to shrink until slightly more than <strong>200 detainees remain &mdash; &quot;the real hard-core people that are very unrepentant, committed jihadists.&quot;</strong> </p><p>What does that make the other 575?
