&lt;p&gt;&lt;p&gt;Despite &lt;a href="../blog/64436-o-reilly-delusional-about-gitmo-torture"&gt;Bill O&amp;#39;Reilly&amp;#39;s delusional rantings&lt;/a&gt;, there is no debate that the U.S. military tortured detainees at Guantanamo Bay.&amp;nbsp; Not when you have former Gitmo prosecutors like  Lt Col Darrel Vandeveld coming forward to testify about the atrocities that occurred there.&amp;nbsp; &lt;/p&gt;&lt;p&gt;&lt;a href="http://news.bbc.co.uk/2/hi/americas/7761315.stm"&gt;Col Vandeveld told the BBC&lt;/a&gt; this week about the Gitmo detainees who had been mistreated in order to secure confessions.&amp;nbsp; In one particularly brutal case, Col Vandeveld discovered &amp;quot;indisputable evidence&amp;quot; regarding the mistreatment of an Afghan named Mohammed Jawad, who had been accused of throwing a grenade at a U.S. military vehicle.&amp;nbsp; &lt;/p&gt;&lt;p&gt;According to the BBC, &amp;quot;After Jawad had tried to commit suicide by banging his head against a wall at Guantanamo, Col Vandeveld says that psychologists who assisted interrogators advised taking advantage of Mr Jawad&amp;#39;s vulnerability by subjecting him to specialist interrogation techniques known as &amp;#39;fear up&amp;#39;.&amp;quot; Interrogators then subjected Jawad to the sleep deprivation technique known as the &amp;quot;frequent flyer&amp;quot; program, in which prisoners were moved from cell to cell every few hours until they confessed.&amp;nbsp; &lt;/p&gt;&lt;p&gt;The Pentagon, as you might expect, disputed Col Vandeveld&amp;#39;s assertions and continues to push the mendacious claim that Bush&amp;#39;s military commissions provide &amp;quot;full and fair trials to accused unlawful enemy combatants who are charged with a variety of war crimes.&amp;quot;&amp;nbsp; And there lies the biggest obstacle once President-elect Obama takes office and closes Gitmo: What to do with the prisoners who still need to be brought to trial, assuming there remains probable cause to believe they&amp;#39;ve committed a crime? &amp;nbsp; &lt;/p&gt;&lt;/p&gt;

&lt;p&gt;&lt;p&gt;Remember back to President Bush&amp;#39;s 2002 &lt;a href="http://www.nytimes.com/2008/11/21/us/21guantanamo.html?hp"&gt;State of the Union address&lt;/a&gt;, when he touted the arrest of six Algerians suspected of plotting to bomb the US Embassy in Bosnia?&amp;nbsp; Well, once those Algerians were brought to Guantanamo Bay, the Bush administration backed away from its initial claims, leaving those detainees to rot without charges for the last seven years -- a perfect example of what Glenn Greenwald calls the &amp;ldquo;&lt;a href="http://www.salon.com/opinion/greenwald/2008/11/20/guantanamo/index.html"&gt;grotesque injustices we have wrought&lt;/a&gt; with Guantanamo and our denial of basic due process to detainees.&amp;rdquo;&amp;nbsp; &lt;/p&gt;&lt;p&gt;Yesterday, Judge Richard Leon (a Bush appointee) ruled that five of those Algerians must be released &amp;quot;forthwith&amp;quot; because the government failed to provide sufficient evidence to detain them. This landmark ruling could signal the beginning of the end for Gitmo, torture, and unconstitional military commissions in our country, particularly with President-elect Obama set to take office.&amp;nbsp; And you can help support that crucial initiative by &lt;a href="http://closegitmo.com/"&gt;signing our petition to close Gitmo&lt;/a&gt;.&amp;nbsp; &lt;/p&gt;&lt;/p&gt;

&lt;p&gt;&lt;p&gt;&lt;a href="http://en.wikipedia.org/wiki/Lorena_Bobbitt"&gt;Lorena Bobbitt&lt;/a&gt; ain&amp;#39;t got nothin&amp;#39; on &lt;a href="http://www.latimes.com/news/local/la-me-cruel13mar13,1,4155418,print.story"&gt;our government&lt;/a&gt;:&lt;/p&gt;&lt;blockquote&gt;&lt;strong&gt;In a stinging ruling, a Los Angeles federal judge said immigration officials&amp;#39; alleged decision to withhold a critical medical test and other treatment from a detainee who later died of cancer was &amp;quot;beyond cruel and unusual&amp;quot; punishment.&lt;/strong&gt;&lt;br /&gt;&lt;/blockquote&gt;&lt;p&gt;I&amp;#39;m sure the judge simply forgot that &lt;a href="http://www.cnn.com/2008/POLITICS/03/08/bush.torture.ap/"&gt;the U.S. is proud&lt;/a&gt; of our &lt;a href="http://seattlepi.nwsource.com/opinion/335178_thomas12.html"&gt;&amp;quot;cruel and unusual&amp;quot; punishment&lt;/a&gt;. An understandable lapse; we can let it pass just this once.&lt;/p&gt;&lt;blockquote&gt; The decision from U.S. District Judge Dean Pregerson allows the family of Francisco Castaneda to &lt;strong&gt;seek financial damages from the government&lt;/strong&gt;.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt; Castaneda, who suffered from penile cancer, died &lt;/strong&gt;Feb. 16. Before his release from custody last year, &lt;strong&gt;the government had refused for 11 months to authorize a biopsy for a growing lesion, even though voluminous government records showed that several doctors said the test was urgently needed,&lt;/strong&gt; given Castaneda&amp;#39;s condition and a family history of cancer, Pregerson said.&lt;/blockquote&gt;&lt;p&gt;There&amp;#39;s that compassion issue raising its ugly head again. What man really needs a penis anyway, right?&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;&lt;strong&gt;But rather than test and treat Castaneda, government officials told him to be patient and prescribed antihistamines, ibuprofen and extra boxer shorts,&lt;/strong&gt; the judge wrote in a decision released late Tuesday. In summary, the judge wrote, &lt;strong&gt;the care provided to Castaneda &amp;quot;can be characterized by one word: nothing.&lt;/strong&gt;&amp;quot;&lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;What, boxer shorts don&amp;#39;t cure cancer? Since when?&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt; &lt;strong&gt;Pregerson blasted public health officials&amp;#39; &amp;quot;attempt to sidestep responsibility for what appears to be . . . one of the most, if not the most, egregious&amp;quot; violations of the constitutional prohibition against cruel and unusual punishment that &amp;quot;the court has ever encountered.&amp;quot;&lt;/strong&gt;&lt;br /&gt; &lt;br /&gt; At this stage of the proceedings, &amp;quot;the only question is whether&amp;quot; the plaintiffs&amp;#39; allegations, if true, show that &lt;strong&gt;government officials &amp;quot;were deliberately indifferent to his condition. The court finds that they do,&amp;quot;&lt;/strong&gt; Pregerson said. &lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;Here&amp;#39;s what the Bad Immigrant was accused of:&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;[T]he Salvadoran immigrant spent eight months in custody on a charge of &lt;strong&gt;possession of methamphetamine with intent to sell, then was transferred to immigration custody because he did not have legal residency.&lt;/strong&gt; &lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;Now he&amp;#39;s dead.&lt;br /&gt; &lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;&amp;quot;&lt;strong&gt;Mr. Castaneda&amp;#39;s case was just outrageous,&amp;quot; Rep. Zoe Lofgren &lt;/strong&gt;(D-San Jose), chairwoman of the subcommittee, said in an interview Tuesday.&lt;br /&gt; &lt;br /&gt; Lofgren said one of the things she found most troubling was that &lt;strong&gt;&amp;quot;bureaucrats&amp;quot; at Immigration and Customs Enforcement in Washington have the power to overrule recommendations of doctors who have actually seen the medical problems of detainees. &amp;quot;That is a recipe for disaster,&lt;/strong&gt;&amp;quot; she said.&lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;In conclusion:&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;&lt;strong&gt;Loyola Law School professor Laurie Levenson&lt;/strong&gt; said the decision was legally significant and factually compelling. &amp;quot;&lt;strong&gt;This was not a detainee with a hangnail,&lt;/strong&gt;&amp;quot; she said. &amp;quot;&lt;strong&gt;You should not have to have your penis fall off to get medical treatment from the government.&lt;/strong&gt;&amp;quot; &lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;We desperately need to take a second look at our penile&amp;nbsp;code.&amp;nbsp;&lt;/p&gt;&lt;/p&gt;

I&amp;#39;d start throwing things, but I don&amp;#39;t want to destroy my own home.&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;&lt;strong&gt;Lawyers representing military detainees at &lt;a href="http://www.washingtonpost.com/ac2/related/topic/Guantanamo+Bay?tid=informline"&gt;Guantanamo Bay&lt;/a&gt; have expressed concern that the government has violated a federal court order by losing or erasing several years&amp;#39; worth of digital video recordings that could shed light on the legality of detainee treatment.&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;The concerns are based in part on a recent court filing by Guantanamo&amp;#39;s commander, Rear Adm. Mark H. Buzby, who said &lt;strong&gt;video surveillance recordings in several areas of the facility have been automatically overwritten and no longer exist&lt;/strong&gt;.&lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;&lt;a href="http://cliffschecter.bravenewfilms.org/blog/25073-incriminating-white-house-emails-poof-gone-forever"&gt;Ring a bell&lt;/a&gt; or 5 million?&amp;nbsp;&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;Defense lawyers said &lt;strong&gt;the admission suggests that the military has not complied with a 2005 court order to preserve such evidence&lt;/strong&gt;, even if the deletion of the recordings was inadvertent. They claim that &lt;strong&gt;the tapes were of potential use at forthcoming court hearings and trials&lt;/strong&gt;, a view supported by a &lt;a href="http://www.washingtonpost.com/ac2/related/topic/Seton+Hall+University?tid=informline"&gt;Seton Hall University&lt;/a&gt; report slated to be released today.&lt;/p&gt;&lt;p&gt;The report, &amp;quot;Captured on Tape,&amp;quot; asserts that&lt;strong&gt; officials at the facility recorded more than 20,000 interrogations at Guantanamo Bay&lt;/strong&gt;. It cited &lt;a href="http://www.washingtonpost.com/ac2/related/topic/Federal+Bureau+of+Investigation?tid=informline"&gt;FBI&lt;/a&gt; statements and military investigative reports as a basis for concluding that &lt;strong&gt;video cameras were in interrogation booths and tapes existed&lt;/strong&gt;.&lt;/p&gt;&amp;quot;&lt;strong&gt;All interrogations are videotaped&lt;/strong&gt;,&amp;quot; said an April 13, 2005, report by the Office of the Army Surgeon General on operations at Guantanamo Bay, cited in the Seton Hall study.&lt;/blockquote&gt;&lt;p&gt;&lt;a href="../blog/23015-cia-torture-tapes-it-s-all-about-public-image-the-last-thing-you-want-is-someone-in-washington-second-guessing-everything-you-did"&gt;What else&lt;/a&gt; does it remind you of?&amp;nbsp;&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;David H. They&amp;#39;ll have perfectly fair and just hearings, be released, and feel good as new!&lt;/p&gt;&lt;p&gt;And hell will freeze over.&lt;/p&gt;&lt;p&gt;According to Navy Captain Theodore Fessel, Jr., &amp;quot;...&lt;strong&gt;authorities have begun seeking new or previously overlooked evidence&lt;/strong&gt; that may warrant new hearings after the process came under fire.&amp;quot; &lt;/p&gt;&lt;p&gt;Let&amp;#39;s examine that last part: After 6 years of calling these guys terrorists, keeping them locked up indefinitely under horrid conditions, and destroying them physically and psychologically, they suddenly have &amp;quot;new&amp;quot; or &amp;quot;overlooked&amp;quot; evidence that just happen to materialize?&amp;nbsp; Because &lt;em&gt;now&lt;/em&gt; these guys are worth a second look?&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;&amp;quot;&lt;strong&gt;With all the outside eyes looking in at the process, it&amp;#39;s forcing us to say, &amp;#39;OK, did we take everything into consideration&lt;/strong&gt; when we did the Combatant Status Review Tribunals?&amp;#39;&amp;quot; &lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;When nobody&amp;#39;s looking, it&amp;#39;s okay to mangle humanity, but now they&amp;#39;re &amp;quot;&lt;em&gt;being forced&lt;/em&gt;&amp;quot; to reconsider? Give me a minute. I&amp;#39;m having an aneurysm.&lt;/p&gt;&lt;p&gt;Lt. Col. Stephen Abraham, an insider who has become one of the most prominent critics of the tribunal process: &lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;&amp;quot;Ultimately, conducting new CSRTs &amp;mdash; even discussing the possibility &amp;mdash; &lt;strong&gt;repudiates every prior assertion that the original CSRTs were valid acts...&lt;/strong&gt; &lt;strong&gt;They are, in essence, both a hypocritical act as well as an act of moral cowardice.&amp;quot;&lt;/strong&gt;&lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;He knows what he&amp;#39;s talking about:&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;&lt;strong&gt;Abraham,&lt;/strong&gt; an Army reservist who was a liaison between Guantanamo tribunals and intelligence agencies and served on a combatant review panel, &lt;strong&gt;made headlines this summer when he told Congress and the Supreme Court that tribunal members felt pressured to find against detainees. &lt;/strong&gt;&lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;So this move is supposed to cover those who no longer pose a threat &amp;quot;in the spirit of being an open and fair process&amp;quot;. &lt;/p&gt;&lt;p&gt;1) It&amp;#39;s never been an open and fair process.&lt;/p&gt;&lt;p&gt;2) Most of them most likely didn&amp;#39;t post a threat in the first place.&amp;nbsp;&lt;/p&gt;&lt;p&gt;3) I&amp;#39;m pissed off.&lt;/p&gt;&lt;p&gt;Out of the original &lt;a href="http://en.wikipedia.org/wiki/Guantanamo_Bay_detention_camp#Facilities_and_detainees"&gt;775 or so&lt;/a&gt;, &amp;quot;its population will likely continue to shrink until slightly more than &lt;strong&gt;200 detainees remain &amp;mdash; &amp;quot;the real hard-core people that are very unrepentant, committed jihadists.&amp;quot;&lt;/strong&gt; &lt;/p&gt;&lt;p&gt;What does that make the other 575? Certainly not &amp;quot;terrorists&amp;quot; and certainly undeserving of being caged like animals with no rights to speak of, because based on that last statement, they were not &amp;quot;committed jihadists&amp;quot; dangerous enough to detain.&lt;/p&gt;&lt;p&gt;This sums it up perfectly:&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;&amp;quot;&lt;strong&gt;Enough is enough &amp;mdash; the military has had nearly six years to formulate, adapt and fix the proceedings at Guantanamo&lt;/strong&gt;,&amp;quot; said Gitanjali Gutierrez of the &lt;span class="yshortcuts"&gt;New York&lt;/span&gt;-based Center for Constitutional Rights, whose many attempts to challenge the detentions have been &lt;strong&gt;blocked by the Bush administration.&lt;/strong&gt;&lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;Enough is enough.&amp;nbsp;&lt;/p&gt;&lt;/p&gt;
