&lt;p&gt;&lt;p&gt;I&amp;#39;d link, but I can&amp;#39;t find this story in the online L.A. Times. From my home paper:&lt;/p&gt;&lt;blockquote&gt;&lt;p&gt;A Ft. Lewis soldier charged with refusing to deploy to Iraq asked a federal court to bar his upcoming court-martial, saying &lt;strong&gt;the Army is violating his constitutional rights by trying him twice for the same crime.&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;First Lt. Ehren Watada is accused of &lt;strong&gt;missing his unit&amp;#39;s deployment in June 2006 and of conduct unbecoming an officer for making public comments denouncing President Bush and the Iraq war.&lt;/strong&gt; His first court-martial was declared a mistrial.&amp;nbsp;&lt;/p&gt;&lt;/blockquote&gt;&lt;p&gt;He could get 6 years in prison for saying what 70% of the nation is saying. Any lawyers out there?&lt;/p&gt;&lt;/p&gt;

&lt;p&gt;The U.S. Army has subpoenaed independent journalist Sarah Olson to testify at the upcoming hearing. Sarah Olson interviewed Lt. Watada last May -- the Army says statements he made during Olson's interview constitute one charge of conduct unbecoming an officer.&lt;/p&gt;
