Afterwards TPMtv caught up with Madam Speaker and asked her, among other things, what she thought of Bush's new "general time horizon" for withdrawal from Iraq. Barack Obama BOTH agreed on unconstitutional amendments to the foreign intelligence surveillance act (FISA) last week, it raised questions about Obama's consistency on civil liberties and about how to best fight this assault on the Fourth Amendment and the right to privacy. I try to answer these questions with some clips from a Barack Obama news conference and from spokespeople for the American Civil Liberties Union (ACLU)</p>

<br />JOHN MCCAIN: "On FISA, I believe it's very dangerous [...] to hold the telecommunications corporations liable for them acting in cooperation with the govnernment after 9/11 to help us monitor the communications of Al-Qaeda and terrorists. [...] I believe the telecommunications company, or any other organization, when called upon by their government, to do something that is in the national security interest, that they should not be held responsible in the way that [...] they're to be sued."</p>
<p>MCCAIN: "[...] Now it's my view that we should have the ability, with certain court procedures observed, to monitor the communications—particularly with the dramatic modernization and ability of communicate [sic] between organizations that want to do America harm. And so, I'm glad you're recording this because I'd like to make sure you show it to all your friends. Have no doubt where I stand: that the telecommunications companies should not be held liable for cooperation they provided the government of the United States after 9/11, when we were trying to stop further attacks on the United States of America. And to say that you want them to be held liable is something in my view that would be a trial lawyer's dream. And I strongly oppose it. Sen. Obama supports it. That's the difference in our views."</p>

<p><p>John Edwards told listeners on the WNYC Brian Lehrer Show that he would not vote for FISA. Edwards, stated, "I do not believe the telecoms should get immunity for illegal acts. So, I would not vote for it." </p><p>In January 2008, Edwards issued a similiar statement against retroactive immunity for the telecoms: </p><blockquote><p>"In Washington today, telecom lobbyists have launched a full-court press to win retroactive immunity for their illegal eavesdropping on American citizens. Granting retroactive immunity will let corporate law-breakers off the hook and hamstring efforts to learn the truth about Bush's illegal spying program. </p><p>"It's time for Senate Democrats to show a little backbone and stand up to George W. Bush and the corporate lobbyists. They should do everything in their power -- including joining Senator Dodd's efforts to filibuster this legislation -- to stop retroactive immunity. And leave town when we did not re-authorized this nation's ability to monitor the telecommunications and the communications of the people dedicated to destroying everything we stand for and believe in. That's shameful.</p>
<p>"That is shameful. It's a thing called FISA. And what it is, my friends - you know how telecommunications have changed in the last 20 years or so. </p>
<p>"You know how easy it is to communicate around the world. Frankly al-Qaeda and evil-doers are pretty adept at it. We found out after 9/11 thanks to the 9/11 commission how good they were at it.</p>
<p>"Now we are trying to give the President the ability to beat back this force of evil and the United States House of Representatives, under democrat leadership decided not to agree, shut down, leave town and go on vacation. The President of the United States said he would have put off his trip to Africa because our nation's security is first with the President of the United States. What is it - where is it in the priority of the leadership of the democratic congress - majority congress, my friends?</p>
<p>"I'll tell ya. I'll tell ya. This is serious stuff.</p>
<p>"You can be proud of the Republican members of the House of Representatives who stood fast - who stood fast behind the President of the United States in helping us combat al-Qaeda and the evil that pervades this world."</p>

I don't have to tell anybody here we are in a dangerous world. I don't have to tell you that it's important - particularly with the tremendous, revolutionary changes that have taken place within telecommunications - that we be able to monitor, detect and track down the evil people that wanna destroy America and everything we stand for. And the democrats decided that they would leave town without passing that bill. My friends, that's wrong. That's wrong. That is wrong! That is wrong! They should come back to town and reconvene and pass that legislation. The President of the United States offered to put off his trip to Africa because this is what National Security [sic]. And, my friends one of the things I wanta do as President of the United States I promise you I'll reach across the aisle to the democrats so we can work to defeat this evil we're facing but you have every right to expect them to reach across the aisle to me and work together for the good of this country. <p>"I don't think the American people want us to be divided in such a way that we cannot adopt the necessary measures that are critical to national intelligence. This is vitally necessary to defend this country."</p>

<br />QUESTIONER: "If you become president you will take an oath, saying you will defend the constitution. Given that, will you try to prevent warrantless wiretaps and searches, which are forbidden under the fourth amendment?"</p>
<p>MCCAIN: "I thank you for the question. In fact it came up in a conversation I had today. There is a careful balance between protection of individual rights and our obligation to defend the security of this country. My friends, we all know—I don't think anyone here disagrees that there are people who are out there, around the world, as well as perhaps or possibly some even within the United States of America or attempting to be established within the United States of America that want to destroy us. </p>
<p>"And they are using the most modern form of telecommunications in order to do so; and look at the way telecommunications has changed within the last 20 or 30 years. So we're not—again, it's a product of this gridlock. I am convinced that we need to monitor communications between terrorists and I think all of us would agree with that. At the same time, we have to [...] as you mentioned, there are certain inalienable rights and among those is the right to privacy. </p>
<p>"So what we really need to do to address this issue is have hearings, have discussions on it. I think that we should have the ability to go and instantaneously and monitor the phone calls of people that we are—that we suspect of being capable or intent on doing bad things to America. So I support the FISA law. I support it. I support it and interestingly enough, in the Senate, there was an agreement between republicans and democrats to move forward and that solution I supported and still support and it got all hung up in the house of representatives and now and now, we are, to a large degree, according to the director of national intelligence without the ability to do some of the monitoring that he feels is vital to the security of this nation. </p>
<p>"See how far we have come, my friends? Where we can't sit down and agree that—on a way that protects people's privacy and, at the same time, gives us the ability to prevent attacks on the United States of America. So I want to assure you that I think FISA was the right thing to do and I would be more than happy to sit down and see if there are modifications that need to be made, but the worst of all words, in my view, is the gridlock we're in, which basically, according to the people we entrust with the intelligence of this country that we're not able to do that."</p>
