&lt;p&gt;&lt;p&gt;The failure to stop Proposition 8, California&amp;rsquo;s anti-gay marriage legislation, was a sad and sobering moment. &lt;br /&gt;&lt;br /&gt;Sad as it furthered this nation&amp;#39;s attempt at parceling out and denying certain freedoms of citizenship.&lt;br /&gt;&lt;br /&gt;It was sobering because it happened during a historic election. &lt;br /&gt;&lt;br /&gt;On the same night the nation elected its first African American president -- for the first time in 40 years it rid itself of Republican rule, embraced the idea of change and said no to dirty and divisive politics as well as war- and fear-mongering ideologues -- California stripped gays of their marital rights. &lt;/p&gt;&lt;/p&gt;

If you have legs, and you are breathing Saturday morning, WHEREVER you are, I am asking you to walk outside of your house and GO.&amp;nbsp; GO for equality.&amp;nbsp; Don&amp;#39;t be scared.&amp;nbsp; Consider it taking a walk around your neighborhood for justice.&amp;nbsp; That&amp;#39;s all.&amp;nbsp; Just a nice Saturday morning walk, with some inspirational yelling.&amp;nbsp; Or just sign holding, that works too.&lt;br /&gt;&lt;br /&gt;Many of you may not even live in areas that you feel are affected by this Proposition having passed.&amp;nbsp; Guess what?&amp;nbsp; You&amp;#39;re wrong if you think that. As long as we are pillaging Constitutions, what&amp;#39;s next, re-enslaving black people?&amp;nbsp; What&amp;#39;s next?&amp;nbsp; Got any rights you especially love and are willing to put up to popular vote?&amp;nbsp; As long as we are putting fellow citizen&amp;#39;s constitutional rights up for popular vote.&amp;nbsp; Unheard of.&amp;nbsp; &lt;/p&gt;&lt;/p&gt;

What kind of moment is it when we take them away? In a nation that is founded on the idea that life, liberty and the pursuit of happiness are inalienable human rights, how can we return to segregation and deny some of our countrymen their happiness? &amp;nbsp;&lt;br /&gt; &amp;nbsp;&lt;br /&gt; We support the basic right of all people to love and to marry whomever they choose to be recognized by the State of California. We urge our fellow Californians to stand up and make this goal a reality. &lt;p&gt;&lt;p&gt;I haven&amp;#39;t had the will to blog here ever since election night due to the &lt;a href="http://prernalal.com/2008/11/04/change-we-cant-believe-in-california-bans-gay-marriage/"&gt;travesty&lt;/a&gt; that occured in California -- every blog post and almost every email I have sent since last Tuesday has been about Prop. H8.&lt;/p&gt;&lt;p&gt;Most undocumented students expressed joy at the election of Barack Obama. When North Carolina went &amp;#39;blue&amp;#39; and nativist Elizabeth Dole lost her re-election bid, Manuel went out into the streets to drink and dance. As the polls closed in Nevada, UCLA graduate Matias jumped into the pool fully-clothed to celebrate Obama&amp;#39;s victory. &lt;/p&gt;&lt;p&gt;Here in California, I stared at the returns for Prop 8. from Los Angeles with a gut feeling that we had lost quite early on even as Barack Obama launched his &amp;#39;victory speech&amp;#39; --&amp;nbsp; &amp;#39;&lt;em&gt;If There&lt;/em&gt; Is Anyone Out &lt;em&gt;There&lt;/em&gt; Who Still &lt;em&gt;Doubts&lt;/em&gt; That America Is a Place Where All Things Are Possible... &lt;em&gt;Tonight&lt;/em&gt; Is Your &lt;em&gt;Answer&lt;/em&gt;.&amp;#39;&lt;/p&gt;&lt;p&gt;The words were empty and hollow. I had doubted that hate would win over love, ignorance and bigotry would win over knowledge and education, and yet I had my answer. America took one step forward just as California took two steps back. &lt;/p&gt;&lt;/p&gt;

&lt;p&gt;&lt;p&gt;As the United States elected its first African-American president it also passed ballot initiatives in a number of states that ban gay marriage and limit the ability of gay couples to adopt children. According to&amp;nbsp;&lt;a href="http://www.thenation.com/directory/bios/richard_kim"&gt;Richard Kim&lt;/a&gt;, Associate Editor of&amp;nbsp;&lt;a href="http://www.thenation.org/"&gt;&lt;em&gt;The Nation&lt;/em&gt; magazine&lt;/a&gt;, the &amp;#39;No on 8 Campaign&amp;#39; failed for three reasons. It was disorganized and slow to respond. It didn&amp;rsquo;t organize in communities of color soon enough. And it fundamentally misunderstood what the yes on 8 campaign was about. &lt;p&gt;&lt;p&gt;&lt;em&gt;Video from a rally at the Mormon church in Los Angeles to protest their funding of an initiative to ban gay marriage in the California constitution.&lt;/em&gt;&lt;/p&gt;&lt;p&gt;From &lt;a href="http://www.thenation.com/doc/20081124/kim"&gt;&lt;em&gt;The Nation&amp;#39;s&lt;/em&gt;&lt;/a&gt; Richard Kim:&lt;/p&gt;&lt;p&gt;Amid the honks and cheers of joy in the Castro and West Hollywood, there are quiet signs of anxiety and, as state election results come in, a growing sense of anguish. Something is not right in the Golden State. Even as Californians gave 61 percent of their vote to Barack Obama, a majority of them, 52 percent, voted to discriminate against another kind of minority -- gays and lesbians. For a brief window that began in the bridal month of June, California queers had the right to marry, thanks to a state Supreme Court ruling, and some 18,000 same-sex couples said &amp;quot;I do.&amp;quot; Proposition 8 -- a ballot initiative that would amend the state constitution to define marriage as between a man and a woman -- now says &amp;quot;You can&amp;#39;t!&amp;quot;&lt;/p&gt;&lt;p&gt;As I write, the results for the second most expensive campaign in the country after the presidency itself are not yet official. According to the No on 8 campaign, as many as 3 to 4 million absentee and provisional ballots have yet to be counted, and gay activists are rightly refusing to concede until they are. But there is little reason to expect that those votes will tip the scales. Other numbers paint an even grimmer picture. If exit polls are to be believed, some 70 percent of African-Americans voted Yes on 8, as did 53 percent of Latinos and 49 percent of Asians; each of these demographics went heavily for Obama; blacks by a 94-to-6 margin. Los Angeles County, heavily minority, went 50-50 on Prop 8. These results have shocked gay activists, who knew from earlier polls, for example, that black voters favored Prop 8, but they were seeing much smaller margins, closer to 50 percent.&lt;/p&gt;&lt;/p&gt;

&lt;p&gt;&lt;p&gt;&lt;span class="nfakPe"&gt;Proposition&lt;/span&gt; &lt;span class="nfakPe"&gt;8&lt;/span&gt; was a proposed amendment that eliminates the right of same-sex couples to marry.&amp;nbsp; Outside special interest groups have spent quite a bit of money in California spreading lies and fear, preying on the hatred and emotion of people to get them to vote in favor of &lt;span class="nfakPe"&gt;Proposition&lt;/span&gt; &lt;span class="nfakPe"&gt;8&lt;/span&gt;.&amp;nbsp; Most of their campaign ads were outright lies. &amp;nbsp;&lt;span&gt; &lt;/span&gt;&lt;br /&gt; &lt;br /&gt; It played out the same way anti-gay issues play out every year.&amp;nbsp; They named it something scary like the &lt;a href="http://www.protectmarriage.com/"&gt;&amp;quot;Marriage Protection Act&amp;quot;&lt;/a&gt; (protecting marriage AND children), presumably because they think those &amp;quot;scary gays&amp;quot; are are not to be trusted. They lied and said that children would have to learn about gay marriage in school; there is nothing in the state education code that requires schools to teach anything about marriage. Even the decision about whether to offer comprehensive sex education is left up to individual school districts. &lt;/p&gt;&lt;p&gt;Then they did what I find most vile and disgusting.&amp;nbsp; They made the issue about religion and specifically targeted the African American and Hispanic communities -- both known to be communities largely built around family and religious faith -- and said that &amp;quot;the scary gays&amp;quot; were trying to ruin the God given sanctity of marriage.&amp;nbsp;&amp;nbsp; &lt;a href="../../blog/61344-the-radical-call-to-support-prop-8-spiritual-warfare-in-the-field-of-martyrs"&gt;They made it a culture war&lt;/a&gt; -- religion&amp;#39;s last stand against Sodom and Gomorrah.&amp;nbsp; &lt;br /&gt; &lt;/p&gt;&lt;/p&gt;

&lt;p&gt;&lt;p&gt;I&amp;#39;m angry and heartsick about what may happen in California on November 4th.&lt;/p&gt;&lt;p&gt;In the most personal way possible, I&amp;#39;m writing to ask you for a favor: help us ensure that gay couples all across California keep their fundamental right to marriage -- the basic right to be treated just like anybody else.&lt;/p&gt;&lt;p&gt;I hope you will forgive the indulgence when I speak from the heart and tell you my personal story.&lt;/p&gt;&lt;p&gt;You see, I grew up in a loving and supportive household, where my family believed I could be anything I chose -- anything except being an openly gay man. Neither of my parents finished high school, and yet, they believed I could accomplish all I set out to do as I went off to Princeton University and Stanford Law School.&lt;/p&gt;&lt;p&gt;They got me through the toughest of times, scrimped and saved, and always believed that failure wasn&amp;#39;t in the cards for me. They had more faith in me than I often had in myself. Whenever my parents visited me at Princeton, my Dad would slip a $20 bill in my pocket when my Mom wasn&amp;#39;t looking. I never had the courage to tell him that the $20 wouldn&amp;#39;t go very far towards my bills, books and tuition. But, it was his support and belief in me that sustained me more than the tens of thousands of dollars I received in scholarships.&lt;/p&gt;&lt;p&gt;When I finished college, they were hugely proud of my -- and their -- accomplishments. That was until I told them I was gay and wanted to live life as an openly gay man.&lt;/p&gt;&lt;p&gt;Though I always knew I was gay, I didn&amp;#39;t come out to them for many years, as I was afraid of losing the love and support that had allowed me to succeed against all odds. When I did tell them, they cried and even shouted. I ended up leaving their home that night to spend a sleepless night on a friend&amp;#39;s sofa. We were all heartbroken.&lt;/p&gt;&lt;/p&gt;

&lt;br /&gt;MITT ROMNEY: What are some differences? Well I've described for instance with regards to military policy, I do not think the President's administration is an 'arrogant bunker mentality" administration. I believe that this President has done everything he could do to keep us safe. Does a president make mistakes? Of course. Will I make mistakes? Of course. But the last thing you're gonna hear me say is that the President of the United States, George W. Bush, is a person who is arrogant with a "bunker mentality." That's simply wrong and uhhh not something I would ever do. Let's turn to other areas, like this one [he points to banner behind him], immigration Umm, when I was Governor, a bill came to my desk. The legislature passed it, the liberals liked it. And it said that the illegal aliens in our state should get a tuition break, they should get lower tuition charges, that citizens from other states should get. And I vetoed that. I said no way are we gonna give illegals, tuition breaks to go to our University. You don't want to create a greater magnet for people to come here illegally. Now Governor Huckabee, when he was Governor, uhh fought in favor of a tuition break for illegal aliens and tax-payer funded scholarships for illegal aliens. So we have a very different view on that aspect. On uhh spending. When I was Governor I tried to hold down spending. My first year, I actually reduced spending. I don't know that if that ever happens anywhere. I'm not just talking about slowing the rate of groowth, uhh growth. I actually brought it down from the year before. And overall, during my four years, it grew, according to the Club for Growth, at 2.2% a year. Governor Huckabee took his budget from $6.7 billion, when he came in, to $16 billion, an increase well of over 100%, almost 150%. So a very different perspective, on how you spend money. And of course, he raised taxes as well. Now he lowered some taxes, but he raised taxes. And net-net he increased taxes by 500 million dollars. I don't like raising taxes. And so we have a very different view on spending and taxes.There is another area of some difference, and that relates to crime. And this is a uhh difference in philosophy. Umm, as a Governor, it's a very unusual thing that happens, I was only in office, maybe a couple months when my chief of staff came in and said, with a whole stack of manila folders. She said these are requests for pardon. These are convicted criminals who want you to pardon them, and let them out of jail... And I said I can't understand why you'd pardon someone who had been duly convicted by a jury of their peers and let them out of jail. And then we talked about it and I realized, there might be some circumstance where perhaps new evidence, DNA evidence, proved someone was innocent. That would certainly be a reason... But after 4 years in office, with all these pardon requests coming through, the number of pardons I gave out was zero. I felt that people convicted should be in jail to the end of the term, as directed by the judge and by the jury. Now, in Governor Huckabee's case, he granted 1,033 pardons, including 12 to murderers. I find that a very different philosophy. And so we have different views on some important issues, and I consider myself more conservative on those issues. Now, there are some places where we stand together. First of all, we're great friends. Number two, we're both pro-life, strongly pro-life. Number 3, we're how many numbers am I up to? [laughter] Number 3, we're uhh, we're in favor of traditional marriage. We both favor a federal amendment to the constitution, defining marriage as a relationship between a man and a woman [applause]. And so we have places where we're the same and places where we're different. But together were a lot closer than the folks on the other side of the aisle.&lt;/p&gt;

&lt;p&gt;MCCAIN: "I believe they were wrong, and I strongly support preserving the unique status of marriage between man and woman. And I'm a federalist. I believe that states should make those decisions.   In my state, I hope we will make that decision, and other states, they have to recognize the unique status between man and woman. And that doesn't mean that people can't enter into legal agreements. That doesn't mean that they don't have the rights of all citizens. I'm not saying that. I am saying that we should preserve the unique status of marriage between one man and one woman.   And if a federal court &#8212; if a federal court decided that my state of Arizona had to observe what the state of Massachusetts decided, then I would favor a constitutional amendment. Until then, I believe the states should make the decisions within their own states."&lt;/p&gt;

&lt;p&gt; 'I just want Junior to be able to come home'

&lt;p&gt;Family and friends gathered at the home of Tim Coco and Genesio "Junior" Oliveira Jr. on Tuesday night for a candlelight vigil marking the one-year anniversary of the couple's involuntary separation.&lt;/p&gt;

&lt;p&gt;Candles, one for each day they have been apart, glowed outside their home.&lt;/p&gt;

&lt;p&gt;"Junior came here in 2002 on a tourist visa and, as they say, the rest is history," Coco told the gathering.&lt;/p&gt;

&lt;p&gt;The couple met in Boston six years ago when Oliveira was visiting from Brazil. A long-distance romance began, and Oliveira returned to the United States. They were married in 2005, after the Massachusetts Supreme Judicial Court ruled that denying same-sex couples the right to marry violated the state constitution.&lt;/p&gt;

&lt;p&gt;But their marriage is not recognized by the federal government for immigration purposes, Coco said, leading the couple on a yearslong journey to get permission for Oliveira to immigrate here legally.&lt;/p&gt;

&lt;p&gt;Coco said the couple have always believed in following and honoring the law. They started the process with immigration to keep Junior in the country in October 2002. After meeting with lawyers, the couple decided to seek political asylum for Oliveira.&lt;/p&gt;

&lt;p&gt;"The State Department lists Brazil as one of the worst human rights offenders in the way they treat homosexuals. The government is very progressive, but the people of Brazil are not," Coco said.&lt;/p&gt;

&lt;p&gt;Immigration officials denied the request for asylum. After the ruling was issued in 2006, the couple immediately appealed, Coco said.&lt;/p&gt;

&lt;p&gt;In the meantime, in 2005, they married and made their home in Haverhill.&lt;/p&gt;

&lt;p&gt;But they were forcibly separated in August 2007 when the Board of Immigration ruled against their appeal.&lt;/p&gt;

&lt;p&gt;"They said he had to leave, calling it voluntary departure but if he didn't leave, they would have put him in jail," Coco said.&lt;/p&gt;

&lt;p&gt;The couple have petitioned Department of Homeland Security. In March, the couple filed an "I-130 Petition for an Alien Relative," the same mechanism heterosexual couples use to gain recognition for immigrant spouses.&lt;/p&gt;

&lt;p&gt;However, the couple expects that request to be denied based on the Defense of Marriage Act, a 12-year-old law that prohibits federal recognition of same-sex marriages.&lt;/p&gt;

&lt;p&gt;The couple will wait for formal denial before challenging the portion of DOMA that prevents federal recognition of their marriage, bringing the case before the First Circuit Court of Appeals.&lt;/p&gt;

&lt;p&gt;"We are legally married so we have standing. There have been cases before us where the couple was not married so neither had standing. However, we are, so we can claim we were deprived of a federal benefit," Coco said.&lt;/p&gt;

&lt;p&gt;If the court rules against the couple, they plan to appeal to the U.S. Supreme Court.&lt;/p&gt;

&lt;p&gt;However, the couple are still looking for an administrative solution.&lt;/p&gt;

&lt;p&gt;"Bottom line, there are so many illegals here and we did the right thing. It's a matter of compassion," Coco said.&lt;/p&gt;

&lt;p&gt;U.S. Attorney General Michael B. Mukasey has the authority to overturn the Immigration Board of Appeals decision, Coco said. The couple hopes that will happen.&lt;/p&gt;

&lt;p&gt;"My goal was not to be an activist and a hero for everyone else, even though they'd all like me to be. I just want Junior to be able to come home. This is a government-sponsored hate crime," Coco said.&lt;/p&gt;
