JOHN MCCAIN: "And I've got to mention one more issue with you very quickly, in case you missed it. The United States Supreme Court yesterday rendered a decision, which I think is one of the worst decisions in the history of this country. Senator Gramm and Senator Lieberman and I worked very hard to make sure that we didn't torture any prisoners, that we didn't mistreat them, that we abided by the Geneva Conventions, which is applies to all prisoners, but we also made it perfectly clear, and I won't go through all the legislation we passed, and the prohibition against torture, but we made it very clear that these are enemy combatants. These are people that are not citizens. They do not, and never have been given the rights that citizens of this country have. My friends, there are some bad people out there. Bad people. So now, what are we going to do? We're now going to have the courts flooded with so-called 'habeas corpus suits' against the government, whether it be about the diet, whether it be about the reading material, and we are going to be all mixed up in a way that is terribly unfortunate because we need to go ahead and adjudicate these cases. And by the way, 30 of the people have already been released from Guantanamo Bay have already tried to attack America. One of them, just a couple of weeks ago, a suicide bomber in Iraq. So our first obligation is the safety and security of this nation and the men and women who defend it."

Valtin The Public Record Monday, June 16, 2008 "No freeman shall be taken or imprisoned or dispossessed, or outlawed, or banished, or in any way destroyed, nor will we go upon him, nor send upon him, except by the legal judgment of his peers or by the law of the land. The Supreme Court decision to render unconstitutional the provisions of the Military Commissions Act of 2006 that curtailed use of habeas corpus by detainees deemed "enemy combatants" by the Pentagon and held at the Guantanamo U.S. military base in Cuba has unleashed a spurt of vitriol from the right-wing establishment. As can be seen above, the Wall Street Journal has picked up the hysterical standard set forth by right wing ideologue Scalia in his blistering dissent to the Boumediene decision, accusing his fellow justices as nothing less than accomplices to murder. With John McCain jumping on the bandwagon, the GOP agenda for the fall campaign is thus established: a liberal Supreme Court, along with an ostensibly too-liberal and inexperienced Democratic candidate for President, are threatening our troops abroad, and making terrorist attacks at home a near certainty. This demagogic assault on civil liberties is dangerous. Setting up your political opponents as criminals is a half-step away from indicating they are outside the pale of appropriate discourse. Such opponents can be targeted themselves by those who are only too ready to carry out the wishes of those they serve. But I consider even more ominous the likelihood that such outlandish statements represent the opinions of the military establishment, who have constructed the Guantanamo hell-hole, and wish to do their best to keep the torture and abuse there as secret and unnoticeable to citizen awareness as possible. Gitmo Prisoners Can Challenge Detention in Court

In a stinging blow to the Bush administration, the Supreme Court has ruled prisoners in Guantanamo Bay can challenge their detention in civilian federal courts. The ruling marked the third time in four years the Supreme Court has ruled against the Bush administration concerning the rights of Guantanamo prisoners.

We speak to Vincent Warren, executive director of the Center for Constitutional Rights, which represents dozens of detainees at Guantanamo.

There are two stories running today. Can you figure out why they're both included this post?

Magna Carta copy to be auctioned--A 13th century copy of the Magna Carta, a milestone of English freedom, will be offered for sale Dec. 10 in New York, Sotheby's auction house said. [...]

King John was forced by barons to agree to the charter in 1215. It guaranteed that freemen would not be imprisoned or deprived of property without due process, including a right to a speedy trial before a jury.

The selling of the Magna Carta is so apt, isn't it? Want to know who's selling it? Ross Perot.

So. Remember due process? Remember--oh what's that silly old outdated, quaint little term--habeas corpus*? Now this:

Lawyers for Canadian Omar Khadr said Tuesday they will appeal a military court's ruling authorizing the Pentagon to proceed with murder and terrorism charges against the alleged al-Qaida terrorist. [...]
"This (appeals) court had the chance to bring some degree of legitimacy to an otherwise lawless process," Kuebler said. "It failed to do so." [...]
...Khadr had only been deemed an "enemy combatant," leaving open the possibility he was legally engaged in battle with American troops. ... Khadr's lawyers say they have been told the case will resume at Guantanamo on Oct. 11. [...]
"It is the latest evidence of the government's determination to rush forward with the flawed military commission process at breakneck speed, disregarding whatever rights of the accused that may get in the way," Kuebler said.

And this:

Although Defense Secretary Robert M. Gates has publicly raised doubts about holding the trials at Guantanamo, officials at the Justice Department and the White House have blocked that decision. Administration officials believe that if the detainees are moved out of Guantanamo, they will have a stronger claim to review under the doctrine of habeas corpus, which would allow the detainees to challenge their detention in a federal, not a military, court.

Khadr, a Canadian, was 15 when he was arrested in 2002 and subjected to unspeakable abuse.

From the diary of Omar Deghayes, a detainee who participated in the strike: Omar Khadr is very sick in our block. He is throwing [up] blood. They gave him cyrum [serum] when they found him on the floor in his cell. Omar was carried to the hospital. As he was being moved back to his cell, he collapsed. The guards beat him.

Instructive lesson today. Two votes. One supporting our Constitution, which we discussed earlier (restoration of Habeas Corpus) and this second one supporting our troops.

In both cases, the Republicans not only vote against the measures in overwhelming numbers, but obstruct the votes and require not a majority, but 60 votes to overcome a filibuster. Only Sen. Lieberman--who hasn't been a Democrat since he won with Karl Rove's money--was in oppposition (of those caucusing with Dems).

So, in other words, the Republicans hate our freedoms, hate our troops and hate our democracy. And they used a tactic they decried when they were in the majority and whining about "up or down votes" for mental ward patients masquerading as judges. So they are hypocrites too.
