Retired Supreme Court Justice Sandra Day O'Connor criticizes the idea of the "activist" judge, and argues for a wider separation between politics and the judiciary.

-----

Sandra Day O'Connor delivers the closing remarks at the 2008 Games for Change Festival. This program was recorded in collaboration with the New School.

The festival will explore real-world impact, the latest games and funding strategies. Expert practitioners -- academics, activists, non-profits, funders -- will be called in to examine the impact of current games, evaluations planned and the ongoing work to build the field - Games For Change

Sandra Day O'Connor (Retired), Associate Justice, was born in El Paso, Texas, March 26, 1930. She received her B.A. and LL.B. from Stanford University. She served as Deputy County Attorney of San Mateo County, California from 1952-1953 and as a civilian attorney for Quartermaster Market Center, Frankfurt, Germany from 1954-1957.

From 1958-1960, she practiced law in Maryvale, Arizona, and served as Assistant Attorney General of Arizona from 1965-1969. She was appointed to the Arizona State Senate in 1969 and was subsequently reelected to two two-year terms. In 1975 she was elected Judge of the Maricopa County Superior Court and served until 1979, when she was appointed to the Arizona Court of Appeals.

President Reagan nominated her as an Associate Justice of the Supreme Court, and she took her seat September 25, 1981. Justice O'Connor retired from the Supreme Court on January 31, 2006.

TRANSCRIPT:
JOHN MCCAIN: My two prospective opponents and I have very different ideas, very different ideas about the nature and proper exercise of judicial power. We would nominate judges of a different kind, a different caliber, a different understanding of judicial authority and its limits. And the people of America, voters in both parties, whose wishes and convictions are so often disregarded by unelected judges, are entitled to know what those differences are.

Reconciliation is not easy in a place like Iraq.

The so-called 'de-Baathification' of Iraqi society following the American invasion, saw members of the former regime hunted down and excluded from any role in the post-Saddam era. The efforts to bring justice culminated on December 30th, 2006 in the hanging of Saddam Hussein, the former Iraqi president.

Amnesty and leniency remains in short supply when it comes to other Saddam's former aides.

New York Times Op-Ed columnist Anthony Lewis criticizes use of the term "activist judges."

-----

The First Amendment: Defending Thought That We Hate with Anthony Lewis.

The First Amendment ensures that all Americans have the right to free speech, but it was only in the 20th century that the Supreme Court began to consistently enforce this basic freedom. A renowned author and literary critic, Lewis will explore how the First Amendment came to represent what it does today, taking a close look at how the courts, public opinion and the political will of the time have influenced its significance over the course of our country's development - The Commonwealth Club of California

Anthony Lewis, twice winner of the Pulitzer Prize, is a columnist for The New York Times. His column, which appears on the Op-Ed page, is called Abroad at Home. Residing in Boston, he travels widely in this country and abroad. Prior to becoming a columnist he was based in Washington, D.C., covering the Supreme Court, and in London as its bureau chief.

Center for American Progress Senior Fellow and Constitutional scholar Mark Agrast says that seven United States Attorneys have been dismissed or asked to leave their posts -- including several prosecutors who have been actively investigating politically sensitive cases involving government corruption or politically connected figures.
These dismissals are legal - US attorneys serve at the pleasure of the President - but several of their replacements are highly questionable and their installation has been made possible by a loophole in the Patriot Act that for the first time allows the Justice Department to appoint replacements without Senate approval. A practice Agrast warns could be a dangerous turning point for the judicial system.

For more on this issue please see Mark's column here: www.americanprogress.org
