President Bush and Attorney General Mukasey have a plan to make the entire globe -- including the United States itself -- a "battlefield" where the president decides who will be locked up forever.
The Bush/Mukasey plan also includes a congressionally-approved subversion of the Constitution and a cover-up of the Bush administration's systemic torture and abuse of detainees.

An ACLU lawsuit recently uncovered new evidence that the torture and abuse Mukasey wants Congress to cover up was authorized by -- you guessed it -- the Justice Department.

It's so outrageous that it seems like a joke or something out of "The Onion." Even The Colbert Report on Comedy Central lampooned the administration's attempts to cover up torture. Unfortunatly, this latest power grab by the Bush administration is no laughing matter.

Nixon Sez: Karl Rove Must Testify

As I explained in this post, Judge Bates has issued a ruling in the House's suit to force Harriet Miers and Josh Bolten to respond to the House Judiciary Committee subpoenas with regards to the US Attorney firings.

With regards to the Miers and Bolten subpoena, Bates emphasizes, his ruling is fairly narrow, in that he doesn't resolve the question of whether or not the White House was right to invoke executive privilege.

It is important to note that the decision today is very limited. To be sure, most of this lengthy opinion addresses, and ultimately rejects, the Executive’s several reasons why the Court should not entertain the Committee’s lawsuit, but on the merits of the Committee’s present claims the Court only resolves, and again rejects, the claim by the Executive to absolute immunity from compelled congressional process for senior presidential aides. The specific claims of executive privilege that Ms. Miers and Mr. Bolten may assert are not addressed -- and the Court expresses no view on such claims.

Basically, then, his ruling requires Harriet Miers to show up before the House Judiciary Committee and invoke executive privilege on a question by question basis. And it requires Josh Bolten (who was subpoenaed to turn over a bunch of documents pertaining to the US Attorney firing), to turn over any non-privileged documents, and provide a description for anything not turned over and the basis for the claim of privilege. In other words, even assuming the White House accepts this ruling (I expect them to at least try to appeal it), the White House and HJC are still bound to get in an argument over whether or not the White House's claim of privilege outweighs HJC's claim to need the information to conduct its oversight duties.

Want some decent news for a change? TPMmuckraker is reporting this:

Less than a month ago, former voting section chief John "minorities don't become elderly the way white people do: They die first" Tanner got canned. And today, his replacement, Christopher Coates, a veteran of the section, demoted Tanner's controversial deputy chiefs, Susana Lorenzo-Giguere and Yvette Rivera.

Wait, so they actually improved the Justice Department's Civil Rights Division? Somebody throw cold water on me.

Thanks a lot. Now my keyboard's shorting out.

The Justice Department's Office of Professional Responsibility is investigating whether Lorenzo-Giguere had filed certain lawsuits in order to get paid while living at her Cape Cod beach house. Tanner was under investigating for approving the arrangement. Both were accused by former section lawyers in complaints to OPR and the inspector general of seeking reimbursement for official travel.

Tsk, tsk, tsk. Now what about Rivera?

Rivera has been accused of discriminating against African-American employees. She oversaw the important Section Five unit, which has the responsibility of reviewing election laws in parts of the country with a history of discrimination. Encouragingly, her replacement is Tim Mellett, one of the staff attorneys who in 2003, found that Tom DeLay's Texas redistricting plan violated the Voting Rights Act, a finding that was overruled by political appointees.

I'll still wait for a shoe to drop somewhere, but this is encouraging.

Did I read this right? Or is this one of those red (as in Republican) herrings:

The Justice Department has reopened a long-dormant inquiry into the government's warrantless wiretapping program, a major policy shift only days into the tenure of new Attorney General Michael Mukasey.
The investigation by the department's Office of Professional Responsibility was shut down after the previous attorney general, Alberto Gonzales, refused to grant security clearances to investigators.

Awww, come on. It's a joke, right? It's a practical joke! Right? Am I right? Is Jon Stewart going to pop out and say, "Kidddddingggg!"

I guess not. No one's there to write that for him.

"We recently received the necessary security clearances and are now able to proceed with our investigation," H. Marshall Jarrett, counsel for the OPR, wrote to New York Rep. Maurice Hinchey. A copy of the letter, dated Tuesday, was obtained by The Associated Press.
Hinchey and other Democrats have long sought an investigation into the spying program, to see if it complies with the law. Efforts to investigate the program have been rebuffed by the Bush administration.
