The Al Franken campaign today produced ballots challenged by the Norm Coleman for Senate and pointed out an interesting pattern. As you can see in the video there is a clear vote for Al Franken, but it the Coleman campaign appears to contend the vote should have been for Norm Coleman because the voter also voted John McCain for President.

There are also two challenged ballots that have votes for John McCain and no vote for US Senate. The Coleman campaign challenged those for "voter intent" as well, indicating they think the vote should have counted for Norm Coleman.

All of these challenged ballots came from Fillmore County.

A post-election ballot review of five randomly selected precincts in Ramsey County yielded one more vote for DFL candidate Al Franken and one less vote for Republican incumbent Sen. Norm Coleman. The two-vote swing, in what represents a small fraction of the entire vote in Ramsey County, may not be reflected in the Secretary of State's running tally for days or even weeks.

The ballots are being recounted, not as part of an anticipated state-wide recount in the US Senate race between Franken and Coleman, but as part of normal ballot review done after every election to determine if the optical-scan voting machines recorded accurately.

Many are looking to the post-election ballot review to provide an indication of how the impending state-wide recount may go.

All eyes are on the ballots that are improperly marked. Minnesota has well-established voter intent laws which allow election judges and election managers to determine whether mis-marked ballots show clear intent for one candidate or another. Many of the improperly marked ballots contain an "X" or check mark in the optical-scan sheet's "bubble."

The optical-scan machines have proven to be very effective. In Ward 3 Precinct 5- there were 14 ballots that had been put in the "questionable" pile meaning they were not sure if the optical scanner had read them correctly because they were marked with an X or not fully filled in. Upon further review, 13 of those 14 ballots were counted correctly by the optical scanner.

Of the five randomly selected precincts that were audited in Ramsey County, the results are as follows:

    * St. Paul Ward 3 Precinct 13:  + 1 vote for Franken
* St. Paul Ward 6 Precinct 5 :+ 2 votes for Franken, and a 1 vote loss for Coleman
* St. Paul Ward 7 Precicnt 14: + 2 votes for Franken
* St. Paul Ward 3 precinct 5 : 1 vote loss for Franken, +1 vote for Coleman
* Roseville Ward 2 : 3 vote loss for Franken, 1 vote loss for Coleman
* Net change +1 vote for Franken, -1 vote for Coleman = 2 vote swing for ...

At the time of the suit, Coleman was leading Franken by a little more than 200 votes which will trigger an automatic recount after the state canvassing board meets later this month. The suit was dissmissed.

The event was billed as official business for Bachmann but a group of veterans, who support Bachmann's DFL and Independence endorsed challeger Elwyn Tinklenberg, called on Bachmann's campaign to refund the tax payers and pay for the event with campaign money.

After remarks by Sec. Peake and Congresswoman Bachmann, both were questioned about the timing and nature of the event. St. Cloud VA Public Affairs Officer Joan Vincent indicated that the event was scheduled six weeks ago by the Secretary's office and Bachmann stated her office put in the request for the visit several months ago..

Despite indicating that she would take questions once outside of the press conference, Bachmann avoided campaign-related questions from an Associated Press reporter. Bachmann and her staff boarded a bus for the short ride to the VA's main building to continue the tour. After stepping off of the bus Bachmann refused to comment on the veterans accusations.

Less than two hours later, Bachmann held a campaign event a few miles away at the Minnesota GOP's St. Cloud Victory Office.

An unmarked envelope arrives for two investigative reporters at the local newspaper. Inside are papers that will be filed in court next week linking the state's Senior US Senator to a complicated plan to funnel him money from a wealthy businessman to his wife.

It sounds like a scene from "All The Presidents Men". But unlike that movie which was based on real life, this scene is based upon a fantasy in Senator Norm Coleman's head if you believe the Managing Editor at the Star Tribune.

Friday, Senator Coleman accused the Star Tribune of having documents from the potentially politically damaging lawsuit long before they were actually filed in a Texas court.

Star Tribune Managing Editor Rene Sanchez says that is simply not true. Sanchez old MinnPost that "we did not get a copy of this lawsuit until it was filed Monday."

It was questions from the Star Tribune's investigative reporters earlier this week that tipped other media off to the story. At a campaign event in St. Cloud, Senator Coleman refused to answer or even acknowledge the reporters who asked him about the lawsuit and payments of $75,000 to his wife from a Texas company controlled by a wealthy Coleman supporter.

On Friday Coleman said the lawsuit, filed by Republican Paul McKim, was politically motivated and indicated it was the work of his opponent Al Franken calling it "sleazy" and "11th hour".

Lawyers in Minnesota who examined the lawsuit documents were reasonably sure politics was not the primary motivation in the lawsuit. Talk show host and lawyer Mark Heaney and election law specialist Christian Sande examined the documents on Heaney's show this week.

Heaney noted that the firm filing the lawsuit was a reputable one, and would probably not risk that reputation by being involved in a lawsuit that had no basis.

Sande commented that this was really a lawsuit about a fired CEO trying to obtain money from his former employer. Sande suggested the Coleman allegations were probably included ...
