&lt;p&gt;Former Solicitor General to the U.S. Supreme Court Walter Dellinger argues that, based on the history of the term "militia" as it relates to the U.S. Constitution, the 2nd Amendment should not be read to imply an individual's right to bear arms.&lt;/p&gt;

&lt;p&gt;-----&lt;/p&gt;

&lt;p&gt;The lead attorneys who argued the DC Gun Ban Case, District of Columbia v. Heller, discuss the strategies that won and lost the case.&lt;/p&gt;

&lt;p&gt;The panel is hosted by the Patton Boggs Foundation and includes Walter Dellinger, lead counsel for the District of Columbia in Heller and Alan Gura, lead counsel for plaintiff Heller.&lt;/p&gt;

&lt;p&gt;The panel is moderated by Lorianne Updike, Esq., co-founder of ConSource.org, the online library of primary constitutional sources containing many of the primary sources used in Heller.&lt;/p&gt;

&lt;p&gt;Walter Dellinger is the Douglas B. Maggs Professor of Law at Duke University. He returned to Duke in August, 1997, after having served as acting Solicitor General for the 1996-97 Term of the Supreme Court. &lt;/p&gt;

&lt;p&gt;After serving in early 1993 in the White House as an advisor to the President on constitutional issues, Dellinger was nominated by the President to be Assistant Attorney General and head of the Office of Legal Counsel (OLC) and was confirmed by the Senate for that position in October, 1993. During his three years as Assistant Attorney General he served as the Department's principal legal advisor to the Attorney General and the President.&lt;/p&gt;

&lt;p&gt;"The 2nd Amendment Right is an individual right and not just a right of militia and that's where I expect the Supreme Court to rule. I think that is a fair reading of the text of the Constitution. I respect the right of lawful gun owners to hunt, fish, protect their families."&lt;/p&gt;

&lt;br /&gt;Associate Steven Breyer (Liberal) - Appointed by Bill Clinton in 1994
&lt;br /&gt;Associate Ruth Bader Ginsburg (Liberal) - Appointed by Bill Clinton in 1993
&lt;br /&gt;Associate Clarence Thomas (Conservative) - Appointed by George H.W. Bush in 1991

&lt;p&gt;GUN RIGHTS - Struck down District of Columbia gun ban! I support gun rights! Our guns, our life and our liberty! No one should regulate our rights to own guns. Protection is our freedom and we should have the right to bear arms. Second Amendment is our freedom! District of Columbia v. Heller&lt;/p&gt;

&lt;p&gt;DEATH PENALTY - Struck down selective death penalty laws! I do support capital punishment (only in regards to treason, espionage and murder). The cases were Indiana v. Edwards and Kennedy v. Louisiana. The Eight Amendment is a protection from cruel and unusual punishment. The ruling was a split thought! &lt;/p&gt;

&lt;p&gt;TORTURE - Struck down White House request to hold military trials for accused terrorist. There are no rights for any terrorist. But in regards to how the system works, any American who is at GITMO should be held in the United States Federal Courts Boumediene v. Bush&lt;/p&gt;

&lt;p&gt;FREEDOM OF EXPRESSION, PRESS AND SPEECH  - Upheld the law to a federal statute prohibiting the "pandering" of child pornography (offering or requesting to transfer, sell, deliver, or trade the items) did not violate the First Amendment to the United States Constitution, even if a person charged under the code did not in fact possess child pornography which to trade. The cases include United States v. Williams and Davis v. Federal Election Commission. Don't push child porn in the direction of me!&lt;/p&gt;

&lt;p&gt;Chief Justice of the Supreme Court of the United States John Roberts delivers the Seventh Annual Barbara K. Olson Memorial Lecture to The Federalist Society.&lt;/p&gt;

&lt;p&gt;On September 11, 2001, at the age of 45 and at the height of her professional and personal life, Barbara Olson was murdered in the terrorist attacks against the United States as a passenger on the hijacked American Airlines flight that was flown into the Pentagon. The Federalist Society established this annual lecture in Barbara's memory because of her enormous contributions as an active member, supporter, and volunteer leader. Solicitor General Theodore B. Olson delivered the first lecture in November 2001. The lecture series continued in following years with other notable individuals. - The Federalist Society&lt;/p&gt;

&lt;p&gt;John G. Roberts, Jr., Chief Justice of the United States, was born in Buffalo, New York, January 27, 1955. He received an A.B. from Harvard College in 1976 and a J.D. from Harvard Law School in 1979.  &lt;/p&gt;

&lt;p&gt;He served as a law clerk for Henry J. Friendly of the United States Court of Appeals for the Second Circuit from 1979-1980 and as a law clerk for then Associate Justice William H. Rehnquist of the Supreme Court of the United States during the 1980 Term.  &lt;/p&gt;

&lt;p&gt;He was Special Assistant to the Attorney General, U.S. Department of Justice from 1981-1982, Associate Counsel to President Ronald Reagan, White House Counsel's Office from 1982-1986, and Principal Deputy Solicitor General, U.S. Department of Justice from 1989-1993.  &lt;/p&gt;

&lt;p&gt;From 1986-1989 and 1993-2003, he practiced law in Washington, D.C.  He was appointed to the United States Court of Appeals for the District of Columbia Circuit in 2003.  &lt;/p&gt;

&lt;p&gt;President George W. Bush nominated him as Chief Justice of the United States, and he took his seat on September 29, 2005.&lt;/p&gt;

&lt;p&gt;Clarence Thomas, Associate Justice, was born in the Pin Point community of Georgia near Savannah June 23, 1948. He married Virginia Lamp in 1987 and has one child, Jamal Adeen, by a previous marriage. He attended Conception Seminary and received an A.B.,
&lt;br /&gt;cum laude, from Holy Cross College, and a J.D. from Yale Law School in 1974. He was admitted to law practice in Missouri in 1974, and served as an Assistant Attorney General of Missouri from 1974-1977, an attorney with the Monsanto Company from 1977-1979, and Legislative Assistant to Senator John Danforth from 1979-1981. From 1981-1982, he
&lt;br /&gt;served as Assistant Secretary for Civil Rights, U.S. Department of Education, and as Chairman of the U.S. Equal Employment Opportunity Commission from 1982-1990. &lt;/p&gt;

&lt;p&gt;He became a Judge of the United States Court of Appeals for the District of Columbia Circuit in 1990. President Bush nominated him as an Associate Justice of the Supreme Court, and he took his seat October 23, 1991.&lt;/p&gt;

&lt;p&gt;He is the author of the book, "My Grandfather's Son: A Memoir."&lt;/p&gt;

&lt;p&gt;Stephen G. Breyer, Associate Justice, was born in San Francisco, California, August 15, 1938.  &lt;/p&gt;

&lt;p&gt;He received an A.B. from Stanford University, a B.A. from Magdalen College, Oxford, and an LL.B. from Harvard Law School. He served as a law clerk to Justice Arthur Goldberg of the Supreme Court of the United States during the 1964 Term, as a Special Assistant to the Assistant U.S. Attorney General for Antitrust, 1965-1967, as an Assistant Special Prosecutor of the Watergate Special Prosecution Force, 1973, as Special Counsel of the U.S. Senate Judiciary Committee, 1974-1975, and as Chief Counsel of the committee, 1979-1980.  &lt;/p&gt;

&lt;p&gt;He was an Assistant Professor, Professor of Law, and Lecturer at Harvard Law School, 1967-1994, a Professor at the Harvard University Kennedy School of Government, 1977-1980, and a Visiting Professor at the College of Law, Sydney, Australia and at the University of Rome.  &lt;/p&gt;

&lt;p&gt;From 1980-1990, he served as a Judge of the United States Court of Appeals for the First Circuit, and as its Chief Judge, 1990-1994. He also served as a member of the Judicial Conference of the United States, 1990-1994, and of the United States Sentencing Commission, 1985-1989.  &lt;/p&gt;

&lt;p&gt;President Clinton nominated him as an Associate Justice of the Supreme Court, and he took his seat August 3, 1994.&lt;/p&gt;

&lt;p&gt;Author and Washington Post editorialist Benjamin Wittes suggests improvements to the federal judicial confirmation process.&lt;/p&gt;

&lt;p&gt;-----&lt;/p&gt;

&lt;p&gt;In "Confirmation Wars: Preserving Courts in Angry Times," Benjamin Wittes examines the process by which nominees are confirmed to the federal courts, compellingly explains that process's descent into partisan acrimony, and warns of the threat to independent courts that the changes threaten. "The Senate," he says, "has created a confirmation process in which it learns little that is useful while pressuring would-be judges to conform to the wills of legislators who do not themselves agree on what results they should demand of nominees."&lt;/p&gt;

&lt;p&gt;Wittes, an editorial writer for the Washington Post, draws on his experience covering judicial nominations and on interviews with nominees and judges to outline how the process has changed over the past 50 years. "Any reasonable account of recent history," he notes, "compels the conclusion that the process has changed dramatically - and for the worse." This process, he argues, is best understood not through a partisan lens -- it has deteriorated regardless of which party has controlled the White House or the Senate -- but in institutional terms, as a legislative response to the growth of judicial power in the past half century.&lt;/p&gt;

&lt;p&gt;The book concludes with a series of recommendations for reforming the process that will confound ideologues on all sides of the judicial nomination struggles. Designed to manage the political conflict surrounding nominations to protect the independence of the courts and the prerogative of the president to choose judges, they include ending the tradition of live testimony by nominees before the Senate Judiciary Committee and accepting the legitimacy of aggressive Senate tactics to pressure presidents to name ideologically acceptable candidates.&lt;/p&gt;
