MCCAIN: "Thank you for the question. My friends, one of the things we have a tendency not to think as much as we should about is the appointment of judges; especially those to the United States Supreme Court. I don't know but some people—a lot of people say there could be as many as two or maybe even three retirements from the United States Supreme Court within a certain number of years.

"I don't know if it's true or not but always there is and so it's very important. And by the way, this is one of the big differences between me and Senator Obama. I happen to think that Justice Roberts and Justice Alito are two of the finest appointments to the United States Supreme Court because they had a record and now have a record of strictly interpreting the Constitution of the United States of America and not legislating from the bench and Senator Obama [...] voted against Justice Roberts and he wanted to filibuster against Justice Alito. So that's a very clear difference between myself and Senator Obama, my friends. Obviously he's for these activist judges and why anybody would vote against Justice Roberts—that's just not within my imagination."

JOHN MCCAIN:"Justice Roberts. [applause] That would be the qualities that I would look for. What I mean by that is some individual who strictly interprets the constitution of the United States [applause] not legislate from the bench. Legislating from the bench has been [applause continues] a big problem. And I may not agree with every opinion that Chief Justice Roberts, uh, renders. But I do believe that he has the qualities that are necessary. Sen. Obama voted against Justice Roberts. Voted against Justice Alito, wanted, uh, uh, remarkable, remarkable. I will tell you that I voted for Justices Bryer and Ginsburg who were nominated by President Clinton, not because I agreed with them, but because they were qualified. They were qualified. Sen. Obama voted against Justice Roberts and Jus-, Justice Roberts and Justice Alito. My friends, you do that and we are have serious problems with the appointments of justices to our courts in the United States of America."

JOHN MCCAIN: "And I've got to mention one more issue with you very quickly, in case you missed it. The United States Supreme Court yesterday rendered a decision, which I think is one of the worst decisions in the history of this country. Senator Gramm and Senator Lieberman and I worked very hard to make sure that we didn't torture any prisoners, that we didn't mistreat them, that we abided by the Geneva Conventions, which is applies to all prisoners, but we also made it perfectly clear, and I won't go through all the legislation we passed, and the prohibition against torture, but we made it very clear that these are enemy combatants. These are people that are not citizens. They do not, and never have been given the rights that citizens of this country have. My friends, there are some bad people out there. Bad people. So now, what are we going to do? We're now going to have the courts flooded with so-called 'habeas corpus suits' against the government, whether it be about the diet, whether it be about the reading material, and we are going to be all mixed up in a way that is terribly unfortunate because we need to go ahead and adjudicate these cases. And by the way, 30 of the people have already been released from Guantanamo Bay have already tried to attack America. One of them, just a couple of weeks ago, a suicide bomber in Iraq. So our first obligation is the safety and security of this nation and the men and women who defend it."

"The 2nd Amendment Right is an individual right and not just a right of militia and that's where I expect the Supreme Court to rule. I think that is a fair reading of the text of the Constitution. I respect the right of lawful gun owners to hunt, fish, protect their families."
