When California voters eliminated the right of same sex couples to get married last week, it led to an immediate legal challenge from the ACLU of Northern California and some ironic commentary from Jon Stewart on the Daily Show, both of which I discuss in this video.

You can find the entire Daily Show segment from which I took a short clip for my video at www.thedailyshow.com

You can find the entire speech James Madison gave when he proposed the amendments that became the Bill of Rights at www.jmu.edu

The picture of the James Madison is a flickr photo available under a creative commons license as indictated on the page with the photo at www.flickr.com

In compliance with that creative commons license, this video may be distributed in accordance with the creative commons license described at creativecommons.org

And, finally, you can read the full text legal challenge to the recently passed California Constitutional amendment eliminating the right of same sex couples to get married at www.aclunc.org

The DMCA is being used as a tool for censorship and a tool for illegally getting the name and address of other Youtube users. Youtubes actions, heavily influenced by the mandates of the DMCA, jeopardizes the safety of the Youtube community. The least that Youtube could do is alert its users of the potential danger of unwittingly revealing their location to an enemy when filing a counternotice. Youtube should also inform users that they have a legal obligation to inform users that they must consider Fair Use before filing a DMCA complaint.

(NOTE: I AM NOT A LAWYER, SO THIS SHOULD NOT BE READ AS LEGAL ADVICE.)

----------------------------------------------------------------------------------------------

Youtubes March 31, 2008 Blog entry saying: We often describe our You Choose '08 platform as "the world's largest town hall" for political discussion.

http://www.youtube.com/blog?entry=IRNhAzKFz_M

I discuss bogus DMCAs issued under the name of the Zizzle Corporation and Viacom in more detail in this video:

http://www.youtube.com/watch?v=YypzdeL47h4

Youtubes DMCA notification procedure:

http://www.youtube.com/t/dmca_policy

Note that there is not one word on this page about Fair Use or about a users legal obligation to consider Fair Use issues before filing a DMCA. Youtube should state that users have a legal obligation to consider Fair Use issues before sending a DMCA complaint. In fact, Youtube should post a link to the recent decision in Lenz v. Universal Music Corporation in which the Judge says exactly that.

http://www.eff.org/files/filenode/lenz_v_universal/lenzorder082008.pdf

in order for a copyright owner to proceed under the DMCA with a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the laws, the owner must evaluate whether the material makes fair use of the copyright. 17.U.S.C. § 512(c)(3)(A)(v). An allegation that a copyright owner acted in bad faith by issuing a takedown notice without proper consideration of the fair use doctrine is sufficient to state a misrepresentation claim pursuant to Section 512(f) of the DMCA.

Seems that anyone who notices that 911 was an inside job is immediately labeled as "unpatriotic". There is wisdom in this children's story, very applicable to the herds of the day. Listen to the FBI jonestown death tape and see just how far the "herd" can go.

The Emperor's New Clothes

Once upon a time there lived a vain Emperor whose only worry in life was to dress in elegant clothes. He changed clothes almost every hour and loved to show them off to his people.

Word of the Emperor's refined habits spread over his kingdom and beyond. Two scoundrels who had heard of the Emperor's vanity decided to take advantage of it. They introduced themselves at the gates of the palace with a scheme in mind.

"We are two very good tailors and after many years of research we have invented an extraordinary method to weave a cloth so light and fine that it looks invisible. As a matter of fact it is invisible to anyone who is too stupid and incompetent to appreciate its quality."

The prime minister was welcomed by the two scoundrels.

"We're almost finished, but we need a lot more gold thread. Here, Excellency! Admire the colors, feel the softness!" The old man bent over the loom and tried to see the fabric that was not there. He felt cold sweat on his forehead.

"I can't see anything," he thought. "If I see nothing, that means I'm stupid! Or, worse, incompetent!" If the prime minister admitted that he didn't see anything, he would be discharged from his office.

"What a marvelous fabric, he said then. "I'll certainly tell the Emperor." The two scoundrels rubbed their hands gleefully. They had almost made it. More thread was requested to finish the work.

Finally, the Emperor received the announcement that the two tailors had come to take all the measurements needed to sew his new suit.

"Come in," the Emperor ordered. Even as they bowed, the two scoundrels pretended to be holding large roll of fabric.

Everyone said, loud enough for the others to hear: "Look at the Emperor's new clothes. They're beautiful!"

  "What a marvellous train!"

"And the colors! The colors of that beautiful fabric! I have never seen anything like it in my life!" They all tried to conceal their disappointment at not being able to see the clothes, and since nobody was willing to admit his own stupidity and incompetence, they all behaved as the two scoundrels had predicted.

A child, however, who had no important job and could only see things as his eyes showed them to him, went up to the carriage.

"The Emperor is naked," he said.

"Fool!" his father reprimanded, running after him. "Don't talk nonsense!" He grabbed his child and took him away. But the boy's remark, which had been heard by the bystanders, was repeated over and over again until everyone cried:

"The boy is right! The Emperor is naked! It's true!"

The Emperor realized that the people were right but could not admit to that. He though it better to continue the procession under the illusion that anyone who couldn't see his clothes was either stupid or incompetent. And he stood stiffly on his carriage, while behind him a page held his imaginary mantle.
- Hans Christian Anderson

YouTube co-founders Chad Hurley and Steve Chen discuss copyright issues regarding web video, in a conversation with Wired Magazine Editor-In-Chief Chris Anderson.

-----

Chad Hurley and Steven Chen in conversation with Chris Anderson.

With YouTube, Hurley and Chen created a new way for millions of people to entertain, educate, rock and shock one another on a scale we've never seen before. YouTube is a platform for everyday people to broadcast their perspectives to the masses.

Musicians, amateur filmmakers, comedians, and professional content owners alike are sharing their videos, and some even rise to the top to become stars. INFORUM awards the founders of YouTube for their ingenuity and talks with them about everything from their homegrown culture to Google to Viacom to what's next on the horizon. -- The Commonwealth Club
