&lt;p&gt;"Pentagon Papers" leaker Daniel Ellsberg criticizes both John McCain and Barack Obama for resisting efforts to reign in Executive powers.&lt;/p&gt;

&lt;p&gt;-----&lt;/p&gt;

&lt;p&gt;Daniel Ellsberg is the author of the Pentagon Papers, which chronicled decades of Defense Department involvement in Vietnam and was one of the turning points in the opposition movement to the Vietnam War.&lt;/p&gt;

&lt;p&gt;Today, the war in Iraq is fraught with criticism, but there are fewer protests and no internal leaks have had the impact of the Pentagon Papers.&lt;/p&gt;

&lt;p&gt;As operations in Iraq continue and the U.S. threatens to attack Iran, Ellsberg compares the two periods, including constitutional issues, and gives his views on the future - The Commonwealth Club of California&lt;/p&gt;

&lt;p&gt;Daniel Ellsberg was born in Detroit in 1931. After graduating from Harvard in 1952 with a B.A. Summa cum Laude in Economics, he studied for a year at King's College, Cambridge University, on a Woodrow Wilson Fellowship. Between 1954 and 1957, Ellsberg spent three years in the U.S. Marine Corps, serving as rifle platoon leader, operations officer, and rifle company commander. From 1957-59 he was a Junior Fellow in the Society of Fellows, Harvard University. He earned his Ph.D. in Economics at Harvard in 1962 with his thesis,Risk, Ambiguity and Decision.&lt;/p&gt;

&lt;p&gt;In 1959, he became a strategic analyst at the RAND Corporation, and consultant to the Department of Defense and the White House, specializing in problems of the command and control of nuclear weapons, nuclear war plans, and crisis decision-making. He joined the Defense Department in 1964 as Special Assistant to Assistant Secretary of Defense (International Security Affairs) John McNaughton, working on Vietnam. He transferred to the State Department in 1965 to serve two years at the U.S. Embassy in Saigon, evaluating pacification on the front lines.&lt;/p&gt;

&lt;p&gt;On return to the RAND Corporation in 1967, he worked on the Top Secret McNamara study of U.S. Decision-making in Vietnam, 1945-68, which later came to be known as the Pentagon Papers. In 1969, he photocopied the 7,000 page study and gave it to the Senate Foreign Relations Committee; in 1971 he gave it to the New York Times, Washington Post and 17 other newspapers. His trial, on twelve felony counts posing a possible sentence of 115 years, was dismissed in 1973 on grounds of governmental misconduct against him, which led to the convictions of several White House aides and figured in the impeachment proceedings against President Nixon.&lt;/p&gt;

&lt;p&gt;Since the end of the Vietnam War he has been a lecturer, writer and activist on the dangers of the nuclear era and unlawful interventions.&lt;/p&gt;

Barack Obama BOTH agreed on unconstitutional amendments to the foreign intelligence surveillance act (FISA) last week, it raised questions about Obama's consistency on civil liberties and about how to best fight this assault on the Fourth Amendment and the right to privacy. I try to answer these questions with some clips from a Barack Obama news conference and from spokespeople for the American Civil Liberties Union (ACLU)&lt;/p&gt;

&lt;br /&gt;QUESTIONER: "If you become president you will take an oath, saying you will defend the constitution. Given that, will you try to prevent warrantless wiretaps and searches, which are forbidden under the fourth amendment?"&lt;/p&gt;

&lt;p&gt;MCCAIN: "I thank you for the question. In fact it came up in a conversation I had today. There is a careful balance between protection of individual rights and our obligation to defend the security of this country. My friends, we all know&#8212;I don't think anyone here disagrees that there are people who are out there, around the world, as well as perhaps or possibly some even within the United States of America or attempting to be established within the United States of America that want to destroy us. &lt;/p&gt;

&lt;p&gt;"And they are using the most modern form of telecommunications in order to do so; and look at the way telecommunications has changed within the last 20 or 30 years. So we're not&#8212;again, it's a product of this gridlock. I am convinced that we need to monitor communications between terrorists and I think all of us would agree with that. At the same time, we have to [...] as you mentioned, there are certain inalienable rights and among those is the right to privacy. &lt;/p&gt;

&lt;p&gt;"So what we really need to do to address this issue is have hearings, have discussions on it. I think that we should have the ability to go and instantaneously and monitor the phone calls of people that we are&#8212;that we suspect of being capable or intent on doing bad things to America. So I support the FISA law. I support it. I support it and interestingly enough, in the Senate, there was an agreement between republicans and democrats to move forward and that solution I supported and still support and it got all hung up in the house of representatives and now and now, we are, to a large degree, according to the director of national intelligence without the ability to do some of the monitoring that he feels is vital to the security of this nation.  &lt;/p&gt;

&lt;p&gt;"See how far we have come, my friends? Where we can't sit down and agree that&#8212;on a way that protects people's privacy and, at the same time, gives us the ability to prevent attacks on the United States of America. So I want to assure you that I think FISA was the right thing to do and I would be more than happy to sit down and see if there are modifications that need to be made, but the worst of all words, in my view, is the gridlock we're in, which basically, according to the people we entrust with the intelligence of this country that we're not able to do that."&lt;/p&gt;

From 1975 to 1976 he also served as chief of his district's Official Corruption Unit. From 1976 to 1987 he was an associate, and then member, of the firm Patterson, Belknap, Webb &amp; Tyler.&lt;/p&gt;

&lt;p&gt;Mukasey was appointed to the U.S. District Court for the Southern District of New York by President Ronald Reagan in 1988 and served until 2006, the last six years as chief judge. During that time, Judge Mukasey presided over hundreds of cases, including the trial of Sheik Omar Abdel Rahman and 11 co-defendants charged with conspiring to blow up numerous sites in New York. Following the terrorist attacks of September 11, 2001, he was widely praised for the speed with which the federal courthouse, located just blocks from the site of the World Trade Center, returned to normal operation.&lt;/p&gt;

&lt;p&gt;Upon his retirement from the bench, Mukasey returned to Patterson, Belknap, Webb &amp; Tyler, in the firm's litigation group.&lt;/p&gt;

&lt;p&gt;Judge Mukasey has received numerous awards over the years, including the Learned Hand Medal for Excellence in Federal Jurisprudence from the Federal Bar Council, the William Tendy Award from the Fiske Association, awards from the Seymour Association, the Respect for Law Alliance, and the Ari Halberstam Award from the Jewish Children's Museum. He also received an honorary degree from the Brooklyn Law School.&lt;/p&gt;

&lt;p&gt;Mukasey's professional and civic activities have included service as a director of the William Nelson Cromwell Foundation and as a director of the Jewish Children's Museum. He has also been a lecturer in law at the Columbia Law School. He was a member of the Automation and Technology Committee of the Judicial Conference of the United States; was chairman of the Committee on Public Access to Information and Proceedings of the New York State Bar Association; was a member of the Federal Courts Committee and the Communications Law Committee of the Association of the Bar of the City of New York; and was a member of the American Bar Association.&lt;/p&gt;

&lt;p&gt;"In Defense of America: Fighting A Different Kind of War, Without Becoming A Different Kind of Country" with Anthony Romero, Executive Director, American Civil Liberties Union (ACLU).&lt;/p&gt;

&lt;p&gt;President Bush says the U.S. is fighting a "different kind of war," but does that mean it must become a different kind of country? Rather than justifying the usurpation of constitutional powers, this war demands that we stick to our core values more strongly than ever, says the ACLU. Romero shares examples from the legal war that he has been fighting at home.&lt;/p&gt;

&lt;p&gt;Anthony D. Romero is the Executive Director of the American Civil Liberties Union, the nation's premier defender of liberty and individual freedom. He took the helm of the 87-year-old organization just four days before the September 11, 2001 attacks. Shortly afterward, the ACLU launched its national Safe and Free campaign to protect basic freedoms during a time of crisis. Under Romero's leadership, the ACLU gained court victories on the Patriot Act filed landmark litigation on the torture and abuse of detainees in U.S. custody, and filed the first successful legal challenge to the Bush administration's illegal NSA spying program.&lt;/p&gt;

&lt;p&gt;Romero, an attorney with a history of public-interest activism, has presided over the most successful membership growth in the ACLU's history and more than doubled national staff and tripled the budget of the organization since he began his tenure. This unprecedented growth has allowed the ACLU to expand its nationwide litigation, lobbying and public education efforts, including new initiatives focused on racial justice, religious freedom, privacy, reproductive freedom and lesbian and gay rights.&lt;/p&gt;
